The image of Orange 1 lounging (sprawling, spreading ?) in black silk or satin pjs is about as erotic as a colonoscopy.

Expand full comment

Omg! I spit my drink lol. And don’t be so mean to colonoscopies!!

Expand full comment

😆😆 dying...

Expand full comment

I actually don't mind a colonoscopy. You get good drugs, go to sleep, wake up after it's all over. They give you a blanket out of the warmer, and bring you a beverage and a warm muffin.

Expand full comment

It's not the actual colonoscopy that's the problem. It's the prep.

Expand full comment

Yes, that image of DJT is more like the prep. Enough to make you gag.

Expand full comment

A new prep is about $100 but worth the money. A small drink - no all nighter. Also,Mayo clinic initiated an ultrasound colonoscopy that’s called a virtual colonoscopy. Of course there’s no camera inside no prep and it is shown to be equally as effective as the internal camera. it’s marvelous for elderly, who are afraid of getting poked by the camera and puncturing their intestine wall. The ultrasound is covered by the same insurances. So it takes that fair out, but it is vastly more friendly. Any gastroenterologist on the Substack please weigh in.:) hasn’t been time for me to have another colonoscopy this year, but I did find the mayo ultrasound for an older friend who had never had a colonoscopy, she is 85 years old and bleeding. She was adamant about not having a colonoscopy. I found the virtual colonoscopy for her and she’s having it on May 15.

Expand full comment

The problem is, of course, if a suspicious polyp is found which is usually removed during a standard colonoscopy, you'll still have to undergo the standard procedure.

Expand full comment

Thank you. Extremely good information. I do up for the camera and the new drink stuff that isn’t so horrid for an all nighter. This very unusual relative has some signs of trouble and refused a colonoscopy and finally I was able to schedule the virtual ultrasound. She knows what’s really going on. I think we’ll have some leverage. Thank you so much, Dale.

Expand full comment

If I'm ever required to undergo another colonoscopy (I won't do it voluntarily), I would pay the money for the new prep. As one who had polyps removed at her last colonoscopy, I agree with what Dale said. Personally, I'd rather get it all taken care of at once, to cut down on the ridiculous number of doctor visits one can require in old age.

Expand full comment

Well there is certainly that!

Very interesting... the Mayo really is a top innovator... up there with MGH and others here in Boston. I am "overdue" to get a colonoscopy... going to enquire about this approach.

When my husband had his first colonoscopy, the nurse didn't get the iv into his vein, but just under the skin. During the procedure he kept saying he felt everything - and they kept giving him more drugs without checking the iv. When the procedure was over, he was so stoned from the drugs that he could barely dress himself - and spent the next 24 hours going in and out of being loopy. The doctor did not even apologize. Needless to say, we found another doctor!

I don’t understand why Smith didn’t fight for her removal a while back.

Before going to the 11th circuit Smith has to have a legally sound argument. At every turn she has thwarted him by kicking the can down the road and not making final rulings that he can appeal.

Expand full comment

Expand full comment

Yes, but she can be impeached, convicted, and then investigated and prosecuted. It couldn't happen overnight or by next Tuesday, maybe 3 years at the least. But it could happen, but only if Biden fires Sister Mary Garland and if the Democrats could revive the DOJ and abandon their feckless and pusillanimous attitudes about prosecuting corrupt members of Congress by filling criminal complaints, (6 year statute of limitations for felonies over Jan6) and judicial misconduct.

Expand full comment

it is very difficult to get a judge removed, the bar is high for DC 11, and although she is a new judge, and made mistakes, she is most certainly coached by very sharp lawyers/judges/ as to how close she can surf the limit of what she can do for Trump. It is a farce. She will not take what she does to Paradise that's for sure.

Expand full comment
founding

Can't Smith argue that there's a clear pattern to her rulings and foot dragging that indicate bias and/or ineptitude? The appellate court already were scathing about her. Maybe they are teed up to do something if only Smith would ask for her removal...?🙏🙏🙏

From what he tweeted today, it seems it can go both ways as to the DOJ decision

It’s not just about Trump, it’s about a faction of extremists with non-respect for Rule of Law and Constitution

It’s the challenge of our generations

Expand full comment

Well, I think she has to make an appealable order for him to take to the 11th. I think she's being very careful not to do exactly that.

Expand full comment

She did make an appealable order when she ordered both prosecution and defense to write jury instructions for her before the trial. She wanted them to write about some thing that was illegally done so the only way they could write about it was in the sense that they approved what had happened. Jack Smith immediately complained about it, but he didn’t appeal to the 11th. Then she had to backtrack.it was kind of a trap that she was setting, but he was pretty smart. She also has ignored the case law he has written about and enough incident like that and he can appeal to the 11th.

Expand full comment

Problem with the "jury instruction" business was that it was a request based on hypothetical situations. While it could easily be viewed as an alarming suggestion of her intent, it didn't quite rise to a confident mandamus or removal appeal to the 11th Circuit because of its "theoretical" nature.

Expand full comment

Expand full comment

Because he was keeping his powder dry, in my opinion, for a really opportune time, which she is making sure doesn't come, i.e., an appealable order. I simply can't imagine a reasonable judge, 18 months or so in to a case, would not have held several important motions hearings by now and made orders that he could appeal. But she hasn't. Maybe (not being an attorney) I'm missing something, but she is holding back on things that other judges would have done waaaaay sooner than this.

It was a big risk.

It needs to be said that even if don ends up in prison, we really need to continue to save our Democracy. I am quite sure one of dons’s MAGA leaders will step in and run. Important we get out the vote and when the time comes VOTE BLUE UP and DOWN the BALLOT.

About a MAGA leader running in Trump's stead (and actually getting anywhere): I don't see it happening, even if Trump is convicted before the Republican Convention. Trump's power is overwhelmingly *personal*. Can that be transferred to someone else? I don't think so. We've already seen how divided the MAGA forces are, in Congress and elsewhere. The Project 2025 people would probably love to promote one of their own as a candidate, instead of having to line up behind Trump, but Leonard Leo and the rest of them like to work in the shadows. The overwhelming majority of USians couldn't identify any of them. I don't believe MAGA is going to fade away if Trump gets locked up or otherwise disappears from the scene -- its roots were there long before he came along -- but I don't think it will be the national threat that it is now.

I heard today that in some cases, defense counsel did NOT object, but Judge Merchan stopped the witness and called out the defense for NOT objecting! This leads me to think that the Defense strategy was to 1) let the offensive testimony slip in, so that they could call for a mistrial, and/or 2) set up an appeal for ineffectiveness of counsel. If so, Merchan calling them out should, and did, mitigate both strategies, because they've been reminded that they need to do their jobs, and not rely on technicalities to get their client off.

Why don’t they create an AD about the fact that Trump LIES so much , it is listed in Wikipedia that he lied over 30,573 times during his presidency?

They grilled Stormy Daniel’s about her credibility. Maybe someone should Google Trump’s lies and state that to color the juror’s minds. He is lying again that it didn’t happen.

Please get this to the prosecutors or to Hakeem Jeffries. We need to remind everyone that Trump LIES!

This case is likely the only case that the public with “hear” before the election. I am getting worried!

And isn’t it ironic that numerous people in his cabinet and those he was linked to were criminally indicted?

Why isn’t anyone talking about how Trump is a notorious LIAR?

Expand full comment

The prosecution’s case should speak for itself without any words or finger-pointing. They are trying to prove, without a reasonable doubt, that they have proven Trump lied about his business records before and while he was president. What Joyce has written and all of the testimony, so far, their case is very good. Stormy has been forthright, even though some of the details might be kind of cringy. In my opinion, that’s what the jury should listen to as she is not a prostitute. She thought Trump might further her career.

To my mind this is the easiest part of the case to establish. What seems like it might be more difficult is to establish that theses payments constituted a felony, since hush money payments per se are not illegal.

Expand full comment

But, these payments prove his motive was to keep this secret while he was already in office of the presidency, also. Let’s not forget that. He was supposed to have removed himself from any private business dealings while accepting the role of president but he didn’t. He is a felon because he lied about his business and he committed fraud. That is what the crux of the case is about.

Great summary, but I've got a question about these two sentences: "Daniels’ testimony was a necessity for the prosecution. Despite the uncertainty her testimony presented—she [Stormy Daniels] is no friend to them—without it, the jury would have had questions about why she didn’t testify." Who's "them," as in "no friend to them"? Context suggests it's the prosecution, but what does that signify? She's not a hostile witness, is she?
