Thank you, Joyce, for explaining these chess moves to us. Article 6, second paragraph is pretty clear. "This Constitution, and all laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land;" If we were to accept the Donald John Trump is immune from prosecution for his crimes, then we are placing him above the 'supreme law of the land'. But we, as a nation have held that no man is above the law. We cannot prosecute someone with "diplomatic immunity", so I suppose Trump could claim that as an agent of Putin he has diplomatic immunity - but he forgot to register as an agent of a foreign government, oops!

Expand full comment

Please don't give him the idea that he has diplomatic Iimmunity, Fay, he might latch onto the gambit next.

Sometimes the court does take up multiple cases if their decision can apply to both. Of course because the Colorado decision that he is an insurrectionist and whether presidents are exempt from being such could possibly be combined and everything could be an omnibus decision.

The courts are as well aware that an election is approaching and I'm pretty sure they will decide this fate quickly. In '68 George Wallace sued because some states were not putting him on the ballot (notably Ohio), and of course Bush v. Gore, so they tend to act pretty quickly in those cases.

Besides the regular weird noises in his head, the "wheels" that are always going around up there are constantly coming up with new evil ideas every day. I bet that if he were to have an MRI done from the neck up, not one radiologist in the world would be able to explain exactly what they saw.

Ken, he already knows that Putin is his daddy. Did you miss that episode of SNL?

No, but absolutely LOVE it when they imitate Trump. The mannerisms are spot on!

I think this one was early on in his term. Jeff sessions was still.Attorney General. So he had this possum under his desk that he would call out and talk to like it was his own daddy and then in this one.SNL, the dialogue changed to some of the staff, talking about Putin being Trump’s daddy. If you go to YouTube, Saturday Night Live, Jeff Sessions, possum, daddy, Putin, Trump - in case you want to watch it, that should pop up something. I laughed till I cried, and it was so wonderful to come on across it because I don’t have television and it was just so priceless to look at that. So I don’t know if Putin being Trump’s daddy was in that session or another one, but definitely Sessions was in both of them. Wish I could remember the date because it was in 2018 that Trump trotted up to Helsinki to meet Putin after G 20 in Germany. That made it especially funny to watch:))

Whichever court hears the appeal, I think Jack Smith should not fail to mention that Trump himself has declared that he would be dictator for a day if he wins the election, but if he wins this appeal on presidential immunity, Joe Biden will be dictator for the next year. That might sink in on the Six.

Expand full comment

What do they have to gain if djt wins the decision and then wins the election? What will they lose? I do not believe the safe guards, if they exist, can stop the Republicans from over throwing the democracy if the one with the fake tan and no plan wins. The first move they make will be their Fort Sumter. What will be the response of the states, the military, the industry titans? It won't be decided by the courts then. There won't be another election (Mr. McConnell) to punt the responsibility to the people (let the people decide). I'm really trying hard not to be an alarmist. I hate myself for wanting to bury my head or get busy making plans to escape, until it's over. But I know deep down their decision on this will remake America one way or the other.

Don’t hate yourself for wanting to put your head in the sand. I feel that way every day, but we both know this is NOT the time e for complacency..I think that is how we got into this mess in the first place. How many of us only started paying attention to politics in 2016? 🙋‍♀️ I always voted, but have to be honest, back in the 80’s-90’s I was raising my family and not paying attention...We let these thugs in, and it is up to every one of us to make sure he and the rest of his thugs never get near the White House again!

I think my point is that they may want to make the president a dictator but while a D holds that office. The Six are nothing if not partisan. And they doubtless believe Biden would make himself dictator if given the opportunity, and appoint Hunter his successor. I don't believe Biden would do that. Like you, though, I believe Trump would. And I agree that that would likely lead to civil war. After all, the Founders pledged their lives, fortunes and sacred honor to our independent republic; can we do less when there's an attempt to destroy their work?

It seems to me that SCOTUS has not at all bent over backwards for Trump regarding the 2020 election. They ruled against him, and/or refused to hear his appeals in some of the 60 cases he lost in the courts after the election and before 1/6/2021. I can’t imagine they’d be solicitous now. They have his number. I’m hoping they take the case on an expedited basis. Keeping my fingers crossed.

SCOTUS may rule against the psychopath bec they do not want him to get into the White House and have more power than them. That is the only reason I think they have done what they have done against him. The conservative justices in SCOTUS are corrupt liars.

Expand full comment

Audrey, you have three replies at this point, all in agreement. I’ll offer a differing opinion. The 60 cases Trump lost were lost because he never produced evidence. The courts had nothing to work with. Please remember that the Federalist Society justices were put on the bench through the efforts of powerful interests out of the spotlight. Over time, this dedicated segment of the bench has reasoned that money is speech, that the first clause of the Second Amendment has nothing to do with the second clause, that stare decisis is optional, and that it will review imaginary cases if it wants to spin law out of thin air. In other words, the conservatives will probably rule according to how they think their side is supposed to rule. If they rule for Trump, it will be because the people in the dark like the way things are shaping up politically. I say this affirmatively because of how weak Trump’s position is. If they rule against him, it could mean that the masters are either done with him or that they see more advantage in creating chaos ahead of the election. I raise that last possibility only because the Republicans are showing a strange propensity for acting as though their aspirations align with Vladimir Putin’s. So I hope SCOTUS rules against Trump, but for reasons beyond what you and others have stated here, I’ll have to see what happens next before I can take comfort in that decision.

Yes, the Court does not consider Trump "one of us", any more than they do you or I. He's not "clubable".

Exactly. Plus, he really isn't the reason they were selected ...they thank the heritage foundation and Mitch McConnell. But he speaks as if he is who they thank for his largesse. They know they would have been nominated and be there regardless of who the Republican president might have been.

I agree with you. We, as citizens of the United States and Donald Trump as defendant, all have a right to a speedy trial. Whether the appellate court or the Supreme Court decides the question of immunity; they need to get a move on. This trial needs to be over and done way before the election.

“In 234 years of American history, no President ever faced criminal prosecution for his official acts”

THIS is an argument? I had no idea until now that trying to overturn a free and fair election was part of Trump's "official acts" as president. Or maybe they meant the extrajudicial means he tried on Jan 6th when he sent his insane cult to the Capitol to try to stop the counting of the Electoral ballots -- was that an "official act?" How about his 30,000+ LIES he told while president -- official acts?

As my late father would have said, "what a crock!" These so-called lawyers have gone WAY beyond defending their client and they seem to be moving rapidly into some places that SHOULD strip them of their strip-mall law licenses. Ugh!

Good synapsis, Joyce. trump is the guy who wants to eat his KFC and have it, too. This is just more of him trying to have it both ways; one would think that "he thou protest too much". Am I the only one who grows weary of him being in our faces day after day with nothing of interest to say? I was watching one of his "hand-picked" groups behind him from a few days ago. Those young men were not even paying attention to trump; they were joking around laughing. Wonder how much his campaign is having to dole out to get young guys and gals to show up "for him". It's a circus. So, yes, come on SCOTUS. Grow a set of man-sized gonads, you conservative Justices & do the correct thing and show trump he doesn't OWN you. You know America wants him Gone. carry on.

"Trump has been permitted to delay the legal proceedings against him for long enough." Indeed, and if I am any example of my fellow Americans that thinks so, we have lost a lot of respect for the courts for catering to his delay tactics. As Dean Roscoe Pound so convincingly set forth one of his writings; ( paraphrasing) the law is not permanent, if not careful ,

the law as we know it can come to an end!”

Since the insurrection , the “law” as we know it has been diminishing as evident that Trumph continues to escape conviction for his egregious crimes from rape , attempted rape, calling for a treasonous insurrection ( 5 dead ) and recently threatening retaliation and retribution against his political opponents!

The Supreme Court will have the rule of Law in their hands on a number of Trumph related cases.

Any one of which ,if mishandled can further

“ bring law as we know it , to an end”.

The legal grave is being shoveled by Trumph and his Republican minions.

There's a reason around 60% of Americans are "down" on the SCOTUS. However, at this point in time they have the final say in all of this (this case, Colorado, and the others once they take their place in the queue). I have not a shred of confidence in this court and nothing will surprise me. (Unless they take this case and rule expeditiously on it - because, the underlying issue here is ABSURD) Are they going to push their "favorability" down further? (Which would, hopefully, motivate MORE progressives to vote for Biden/Harris next year) I say, let's get on with it. However here's an interesting thought: If somehow Trump manages to put off this trial for, well, ??? - then the "hush money" case will likely take its place. Should Judge Cannon put off the STOLEN documents case Fani Willis will fill the "vacuum." Both of these cases are not "eligible" for any kind of "pardon" coming from the federal government. As the saying goes "be careful what you wish for!"

Joyce,

You've outdone yourself again! I read the table of contents, scanned through some of what you've written, and was impressed with what I've seen thus far. I'm going to sit down first thing in the morning so I can reread all of it and absorb it better.

We ARE in this together.!!!!

Dianne, We have more information now than at any time in history. Sometimes all the information coming at us can cause some anxiety. But having information as truth as Joyce presents it is so valuable. More knowledge, and having a group such as this one can give you a perspective that we are on a journey of change, leading to a positive outcome and we're going to be fine. It's part of a bigger more positive 'change' toward truth. More truth allows love and health to surface - and when we review history, we can gain a perspective of calmness.

I'd really like to know if the Justices owe anything to the President during whose term they were appointed. IMany times, it's simple circumstance, such as the death of a Justice, that prompts the choice to fill a seat (not counting Mitch McConnell's deliberate delay in filling a seat,, of course). They have lifetime jobs and their tenure will far outlast Trump's lifetime. While I realize that some Trump supporters and right-wing voters who have taken aggressive stances may pose an actual threat to members of the Court, and that, whenever they near the case, their decision will have far-reaching effects, they really have nothing to lose by turning down Trump's argument. And if the "Trump judges" owe loyalty to anyone for their appointments, it's the Federalist Society.
