I suppose if I ever stop laughing at things such as this: “…request that the Court preclude one of the People's witnesses from testifying at trial on the ground that defendant anticipates that he will disbelieve the witness's expected testimony” I might as well start drinking myself into oblivion. Taken as a whole, this situation isn’t funny at all but I’m glad I can still find humor in the details.

And he doesn’t want public statements he made used as evidence because they are “irrelevant, stale and cumulative”. Here’s a suggestion for Trump: if you don’t want your words used against you, STFU.

Thanks for this piece today Joyce.

I always look forward to your thoughts on these legal matters. Your clear analyses give me a much better understanding of the technical legal details.

Talk about throwing spaghetti at the wall!

He's trying everything to exclude evidence and testimony. He's even trying the "Liar, liar, pants on fire" defense against Cohen.

How does he find lawyers willing to put forth these ridiculous arguments? Especially given his current financial status and his record of non-payment.

Expand full comment

I wonder too, how any self-respecting attorney could align with a client who lies to them and then won't pay them.

Expand full comment

How much trial experience do these lawyers actually have? Consider his appointees if elected. The bottom of the barrel in each field, and or no experience in the department, but oh wait, Project 2025 is all about the spoils, and eliminating entire agencies.

Expand full comment

Think about it—what self-respecting attorney would sign up to defend tfg in this case?

Expand full comment

Exactly. No decent/good lawyer or firm will take his cases. Now apply that to a possible administration. What then? And add his main source of high $ donors goals, Project 2025 ( Federalist Society, Heritage Foundation, Turning Point, Christian Nationalism. Who will Trump appoint in his cabinet and agency heads? Rudy as Sec of State? Probably not that bad, but you get the idea of both the incompetency and corruption that will become reality should he be re-elected, or by stealing the election administratively with the Supreme Courts help, even by violence when/if it comes down to it. No-one of substance, morals, or leader in their field would dare soil their career and reputation to work such for a known malignant narcissist sociopath that is operating in a disassociation/delusional state of mind. nobody goes to work for an insane person, expect the weak ( Alan Wiesleberg), other insane people ( Rudy) , the corrupt (the entire first cabinet) the evil (Steven Miller and Steven Bannon), the addict ( Rudy), the greedy ( Jared Kushner/Steve Mnuchin).

We need to project into a possible future, who would take these positions in a Trump 2.0 Administration. Who will execute Project 2025, and how. Possible Hailey voters should be aware of Project 2025 and even they should be scared like hell of this possibility.

Taylor Swift....are you listening!

Yes, I agree. And that the SCOTUS is willing to trash their entire legacy in defense of this man who got 3 of them their positions to do his bidding boggles the mind. That the so-called "liberal" judges did not work to get Thomas' to recuse and also did not protest/dissent shows to me anyway, they are willing to de-legitimize the body of work for the Court in deference to the rule-of-law, the Constitution and the American people. Let the chips fall where they may but allegiance to a traitorous dictator wannabe will have its pitfalls.

Alina Habba had no trial experience, but she's pretty and gullible. Some of these fools are obviously hoping for a future gig in the Trump administration.

We cancelled in January. Couldn't take spending good money on biased, unfair coverage. "Both sides same-ism" got tiresome.

Now I'm sending the dollar equivalent of NYT monthly subscription to Joe's campaign. Win-win!

I am going to write them and tell them to shove their stupid polls and shove them up their Maga-asses. Sorry for the crude words, but they are a disgrace to civil discourse.

Oh let's not get started on the use of profanity!.

I hardly read anything from them any more. Sign my name to your letter! I like the recipes...

Expand full comment

I wonder if the NYT and other publications are not covering them as assiduously is because they are in fear of being shut down by tfg if he’s elected. Considering his new buddy Orban has done this in Hungary it stands to reason. And quite honestly if this is their reason they have no backbone.

George, that might explain a lot. I never thought about that until just now.

I've missed the elephant in the room in my living room more than I can say. Even stumbled over him once while on my way to close the front door! Fortunately, a nearby chair kept me from getting hurt. The elephant freaked out more than I did because I woke him from his beauty sleep.

The fact that tRump's lawyers filed 11 motions in limine suggests to me that he's really afraid of losing this case and getting slapped with a conviction. Given the key ones presented here by Joyce - the witnesses he wants barred, the *res gestae* elements, etc. - tRump is arguing essentially for having no prosecution evidence presented, and let him walk a free man. Nice try, mate, but not in this court!

Expand full comment

I have a few thoughts to share. However, there is one thing Joyce has written that gives me great pleasure: "But for the most part, Trump’s motions simply disagree with well-established legal principles or prior rulings made by the Judge in a manner that comes off as petulant and whiney."

I think that sums things up very nicely! Onward!

Expand full comment

There’s nothing legal about anything Trump says or thinks. The man is a serial criminal and liar.

I absolutely LOVE Joyce's way with words!

Professor, thank for the link to the DA's "MIL's", motions in limine. Those pre-trial hearings are where cases can be won or lost.

The Jury will have no issue with a fixer who did time at Rikers for "Co-conspirator No. 1".

Expand full comment

Nicely laid out, Joyce. I can't but will wait for this trial to start. I think the Biden campaign or surrogates should be talking about all of trump's denials of wrongdoing via his words "witch hunt". They should hammer trump with "if he's so innocent, why does he want immunity? If he's so innocent, why does trump keep postponing his trials. He should want to go to court to prove his innocence. Of course, trump isn't innocent. I believe SCOTUS will not grant immunity, because what would stop Biden from going "outlaw"? Biden could do things like trump did while in office, and I don't mean play golf over 400 times and enriching himself and his family members while in office. I'm crossing my fingers on that one. I yield back my time to Katie Porter!

Bill, I wouldn’t put it past this SCOTUS to rule immunity just for tfg, and not for anyone else. That’s how ridiculously biased they are. He’s the theocrats’ useful idiot!

This question refers to the previous day’s news about SCOTUS. I am bothered that Justice Thomas refuses to recuse himself because of his wife’s involvement in the 2020 election. Is there no recourse for this refusal? Can Justice Thomas be sued for not recusing himself?

Thomas' recusal should not be voluntary. He should be recused by the rest of the court.

Thank you for this information. It is very helpful.

What I can't wait for are the reports that will come out of that courtroom about trump's behavior.

He will be trapped there for hours, unable to get away with storming out, I presume, as he is required to be there. His huffing and and puffing and muttering in front of the jury will be immediately dealt with, I would think.

This trial will be very different than the civil trial without a jury.

He'll have a whole lot to complain about.
