I suppose if I ever stop laughing at things such as this: “…request that the Court preclude one of the People's witnesses from testifying at trial on the ground that defendant anticipates that he will disbelieve the witness's expected testimony” I might as well start drinking myself into oblivion. Taken as a whole, this situation isn’t funny at all but I’m glad I can still find humor in the details.

And he doesn’t want public statements he made used as evidence because they are “irrelevant, stale and cumulative”. Here’s a suggestion for Trump: if you don’t want your words used against you, STFU.

The fact that tRump's lawyers filed 11 motions in limine suggests to me that he's really afraid of losing this case and getting slapped with a conviction. Given the key ones presented here by Joyce - the witnesses he wants barred, the *res gestae* elements, etc. - tRump is arguing essentially for having no prosecution evidence presented, and let him walk a free man. Nice try, mate, but not in this court!

I have a few thoughts to share. However, there is one thing Joyce has written that gives me great pleasure: "But for the most part, Trump’s motions simply disagree with well-established legal principles or prior rulings made by the Judge in a manner that comes off as petulant and whiney."

I think that sums things up very nicely! Onward!

Professor, thank for the link to the DA's "MIL's", motions in limine. Those pre-trial hearings are where cases can be won or lost.

The Jury will have no issue with a fixer who did time at Rikers for "Co-conspirator No. 1".

Nicely laid out, Joyce. I can't but will wait for this trial to start. I think the Biden campaign or surrogates should be talking about all of trump's denials of wrongdoing via his words "witch hunt". They should hammer trump with "if he's so innocent, why does he want immunity? If he's so innocent, why does trump keep postponing his trials. He should want to go to court to prove his innocence. Of course, trump isn't innocent. I believe SCOTUS will not grant immunity, because what would stop Biden from going "outlaw"? Biden could do things like trump did while in office, and I don't mean play golf over 400 times and enriching himself and his family members while in office. I'm crossing my fingers on that one. I yield back my time to Katie Porter!

This question refers to the previous day’s news about SCOTUS. I am bothered that Justice Thomas refuses to recuse himself because of his wife’s involvement in the 2020 election. Is there no recourse for this refusal? Can Justice Thomas be sued for not recusing himself?

Thank you for this information. It is very helpful.

What I can't wait for are the reports that will come out of that courtroom about trump's behavior.

He will be trapped there for hours, unable to get away with storming out, I presume, as he is required to be there. His huffing and and puffing and muttering in front of the jury will be immediately dealt with, I would think.

This trial will be very different than the civil trial without a jury.

He'll have a whole lot to complain about.

"Uh, no testimony by witnesses who dislike me or disagree with me should be admitted."

Sure thing, Donald Dumbass...

Thanks so much Joyce. Be sure to rest and give the critters a hug from us, too.

This is like a soap opera gone bad. Trump doesn’t want anything presented as evidence. He knows he is GUILTY! Too bad DA can’t just read the motions in limine to the jury. Unbelievable.

Joyce, your explanations of the arguments are so helpful and to the point. I feel hopeful…. I will read DAs 41 page response that you provided to us. Have a good night.

So the defendant wants all the evidence excluded and the case dismissed??!!? 😂😂😂😂😂😂😂!!!!

I'll start by saying that I have no formal legal training.

But . . .

Is it not obvious that Trump's motions are a continuation of the same pattern that he is accused of in trying to suppress evidence of his alleged wrongdoing, and clearly demonstrate motive and consciousness of guilt?

As things seem to be falling into place in this one, I'll just remind all to get their popcorn before it runs out, and as always, I'll be pullin' for the pullets.
