Possibly a silly question: Who gives a flying ---- what Cannon says at this point? Why does anyone give her "orders" the slightest attention? She's out of the game.

And forgive me if I repeat myself -- can't remember where I've aired this view recently. There had better be several digital copies of the full, unredacted report safely stashed around the world, to be released at the given signal. If the various malevolent and corrupt forces at play succeed in preventing the report's release, let the signal ring out, let the truth see the light of day, and let the chips fall where they may.

Sure, including Woodward on the distro would be OK. But I'd start with ProPublica, The Guardian, Meidas Touch, maybe Talking Points Memo, and <add your favorite truth-telling, democracy-defending independent information outlet here>. I wouldn't even waste the bandwidth sending copies to NYT and WaPo and LAT.

Judge Cannon's own orders in January 2025 provided further proof that Judge Cannon is corruptly abusing her position and powers and she is acting like a mere con man to deceive the American public. In footnote 2 to her January 13 order, Judge Cannon very publicly threatened DOJ attorneys with disciplinary action for potential lack of "candor' with respect to their "representations made to this Court." Yet, Judge Cannon said nothing to Trump's attorneys about their obvious (and irrefutable) lack of candor.

An actual future prosecution of Trump's accomplices by the DOJ under Trump's influence (or actual control) is the crucial "fact" on which the Defendants' so-called Emergency Motion (to conceal information from the American people) depended. Yet, the Defendants failed to present any evidence (or even argue) that the DOJ actually would pursue any prosecution of Trump's accomplices after Trump's inauguration. Judge Cannon certainly did not ask the DOJ to present any such evidence. Instead, in her January 13 order, Judge Cannon merely emphasized that the "parties agree that Volume II" merely somehow "concerns this criminal proceeding."

When a judge relies on something that parties merely "agree" rather than on the facts and evidence that the judge KNOWS the law REQUIRES, that's a red flag. The parties' mere agreement that information merely somehow "concerns this criminal proceeding" clearly and irrefutably is not the standard that governs Judge Cannon's own conduct. Even the Defendants' own motion emphasized that fact (and the controlling legal standard).

As the Defendants counsel (and Judge Cannon) knew, the Defendants must actually believe (and show "good cause" (per Rule 6 of the Federal Rules of Civil Procedure) to believe) that "there is a reasonable likelihood that" public "dissemination" of the information in Vol. I or Vol. II actually "will interfere" (in a material respect) "with a fair trial or otherwise prejudice the due administration of justice.” Judge Cannon knows the Defendants did not show such good cause.

Trump's own public statements (and other compelling facts, including Trump's choices for leadership positions in the DOJ) establish there is no "likelihood" of a "fair trial" or "due administration of justice." Even before Trump was elected, he publicly boasted that he, personally, "would fire [Jack Smith] within two seconds" after Trump's inauguration. Trump made that campaign promise to his supporters.

Smith, himself, compellingly proved he believes Trump will at least cause Smith to be subjected to harassment and retaliation and cause justice to be obstructed and he believes the DOJ will not prosecute Trump's accomplices. As Judge Cannon already knows, Smith already has resigned.

Trump and his counsel provided further compelling evidence that they all expect the termination of these criminal proceedings against Trump's accomplices. In a motion on Jan. 7, 2025, Trump and his counsel actually argued and represented to the Court that "President Trump should be permitted to participate in these proceedings" precisely because Trump is the "soon-to-be President."

It is not even plausible that Trump and his counsel would insist on Trump's "right" to participate in criminal proceedings that they expect will continue all the way to trial. For years, Trump and his counsel worked hard to get out of such proceedings. For years, they asked judges of multiple courts to pretend that Trump had immunity from prosecution for his crimes specifically because participating in such proceedings would interfere with the president's ability to perform his duties.

Everybody: Jen Psaki interviewed ANDREW WEISSMANN on her Sunday show today.

Andrew pointed out Merrick Garland alone could release "substantial information" in JACK SMITH's report on the "classified document case". Andrew stated clearly that it was a "mistake" not to release Jack Smith's information in his report, Volume II, "about a lot of people" specifically calling out KASH PATEL. Jen Psaki stated she would "follow up on that" information.

There is much work that must be down now. Kash Patel's Senate hearing is waiting on the receipt of the Patel's FBI background check. The FBI has conducted interviews. We need Smith's Volume II in whole or relevant parts ASAP. Jen's interview of Andrew starts at the 29 minute time marker on her show.

The U.S. Attorney General (Garland) should stand up and support and defend the U.S. Constitution as he swore to do. Lawyers certainly need not comply with an illegal order by any judge. The American Bar Association's Model Rules of Professional Conduct Rule 3.4 emphasizes that a lawyer may "knowingly disobey an obligation under the rules of a tribunal" if he or she does so by means of "an open refusal based on an assertion that no valid obligation exists." Rule 8.4 also emphasizes that lawyers must not "knowingly assist a judge or judicial officer in conduct that is a violation of applicable rules of judicial conduct or other law."

That's a good question and there's a good answer to it. A lot of retired or semi-retired lawyers and judges (or law professors or law students) out there could be and should be doing more of what Joyce is doing--using their knowledge and writing skills (and learning more) to expose and oppose the misconduct of judges (like Cannon) who are attacking and undermining our Constitution.

Lawyers who are actually practicing before judges are afraid of judges. Too many judges too often act in mean, spiteful ways to attack lawyers who expose judicial misconduct. Judges in multiple courts commonly gang up on a lawyer who dares to expose judicial misconduct. But there's not much a judge can do to retaliate against a retired lawyer or judge for exposing the lies and crimes of judges. More retired lawyers and judges need to file more complaints against judges who violate the Code of Conduct for United States Judges.

Federal judges do not have to be team players in their courts. They are virtual islands. The worst thing that can happen to them is getting chastised by an appeals court or the SC (a rarity) or impeachment (even more rare.) Well I understand the health risks and yes there are some. My family had had gas stoves my entire life and the one time I had an electric stove I could not use it properly. I expect the loss of good cooking was more harmful to our health than the relatively small risk from gas stove.

However consider that we STILL permit the sales of tobacco which is about 200x more dangerous to the health of Americans (both smokers and those of us who have to inhale the exhausts) than gas stoves.

I suggest we pay attention to the things that are IMPORTANT and not worry so much about the smaller issues.

To you and Bill... it would be phased out. As well you can learn to cook great meals on electricity. But this is not only about your health, if you don't care.

Some, as well, don't have the choice because their apartments come with gas stoves. This should not be imposed on people who rent. NYC .. for instance. With re tobacco.. you cannot smoke in many places now. You can go ahead and smoke in your home outside and your car. Gas stoves surely will still be sold but restricted due to these health hazards.

I suggest you don't decide what is important to a person's life.

I am old. I am low income. I am afraid. I have "prepped" a lot for what comes after January 20th.

I bought cleaning supplies to last a year, because they can be stored and last a long time. Saves money for other higher prices, later.

I bought a new Kindle, a new phone, and a new tablet. All are spares, so I can always communicate. These items are going to be expensive.

I am eating everything in my pantry, freezer, cupboards right now. Prior to January 20th, I will shop for all new stuff to store and freeze. The groceries will skyrocket, because Publix CAN...

And as someone here brikliantly suggested a while back, I will look for a roommate if my Social Security is cut!

Well this is a bit nit picky. Bill Clinton claimed a mandate when he won with only 43% of the vote (that was the year Ross Perot got a substantial number of votes). The mandate claim is based on number of electoral votes which are the only votes that actually count. Trump got more electoral votes in 2024 than he did in 2016 when he also won but lost the popular vote. This time he won both even if his popular vote margin was slim.

In any sense it is irrelevant. He won, the people (us) lost but that's the way our election system works. I am much more sympathetic to arguments against his really fatuous nominations like RFKjr, Tulsa Gabbard and Kash Patel.

I can not see why anyone would want to live in Texas anymore. What a corrupt state, with amazingly corrupt leaders. I feel sorry for you if you have to stay because of employment or family. I don't care how beneficial that place is for things like taxes, it would feel like prison to me. With all its failings, California still feels like a better place to live.

I live in texas too. It is not an easy task to up and move to a different state. Unfortunately money has everything to do with it. Thank goodness I live in a Democratic city in a sea of red. We have decent politicians at the local level. That is who I will pay attention to. Felon 47 will NEVER be my president, ever, and I will not acknowledge it, either. cruz and cornyn (not capitalized to show my consternation) both suck and are mostly worthless as senators, especially cruz.

Yes. I wouldn’t live anywhere else in this state. But honestly if I could, I would move to Oregon in a New York minute. But we just can’t swing it; we have the most wonderful neighbors who we are very good friends with, my sister, her partner and 2 kids are here as is my cousin who I am also friends with.

I live in Oregon - I believe it's a hares breath from becoming Republican. 2/3 rds of the state doesn't even want to acknowledge our Lesbian Governor. It's only because of Portland Metro & Willamette Valley there's enough "D" voters to win by a slim margin. You can bet when Trump starts cutting off federal funds, OR leaders will collapse like an aluminum bumper. I'm hoping to move back to CA even though my family are Oregon Pioneers & I've lived here more than half my life.

Absolutely, Jon. My kids and I moved from near Houston, Texas to near San Francisco, California, 35 years ago. I don't think I'll ever go back. I'm very grateful to be in a blue city in a solidly blue state, surrounded by people whose ideology corresponds to mine, despite the problems.

I would put my money on the Congress people who got the report if any of them were Democrats. Otherwise, we’re asking a career civil servant to jeopardize the pension they earned through long difficult effort. That seems too much to ask.

Not just their pension. They risk jail time. A congress person has some immunity due to the speech and debate clause of the Constitution.

I still wish Biden had considered issuing a nationwide blanket pardon to ALL citizens for all federal crimes committed prior to the date of the pardon. Maybe he still will on Jan 20. Most people would be unaffected but anyone who did something like a leak would be 100% protected from prosecution.

Why not? Trump will pardon them all anyway. The idea is a general pardon for EVERYONE so it's not considered favoritism like pardon he issued for Hunter. Sure some will get them who don't deserve it but mercy is a good thing IMHO (and I'm not even religious!)

The main thing with a general pardon is it leaves NO ONE for Trump to go after at all!

Also, WHY is the 11th Circuit not immediately quashing Cannon’s meddling given that there is NO case before her? I don’t understand why she is permitted so much latitude when she has brought a measure of shame on the rule of law by her questionable rulings and judgements. It is so frustrating that blatant interference is allowed to be taken seriously.

The US is the prosecutor. Smith was just the prosecuting attorney, but criminal prosecutions are always brought in the name of the government. That protects each case if someone has to resign or retire.

What about the idea floated by Kristy Greenberg on Nicole Wallace's "Deadline: Whitehouse," that Merrick Garland drop the documents case against the two co-defendants (small fish, about to be pardoned) and let America see the report?

Garland says he's withholding it to protect the process of a trial that will never happen. Focused on his department's reputation for integrity, he is actively preparing the spectacle of Trump escaping judgment, ending the case, AND deep-sixing the report. How does such a lose-lose-lose outcome build confidence in our system's effectiveness?

Some folks have already covered this in other places. It's true that a number of countries do deny entrance to felons, which I know because I happen to know a felon. But that felon has been to countries recently that previously denied access. I don't know whether it's because time has expired on that or what but I have very serious doubts that anybody is going to deny Trump access on the basis of being a felon.

Not too much. Technically yes, but at the same time once he is in office, he could have the benefit of sovereign immunity (given to ambassadors and other federal workers in foreign countries) and most countries who want to be friendly with the US aren't going to pick a fight over that. It's not like he was convicted of murder of something (although who knows, right?)

Its important to us but in other countries they really don't care about how leaders get into power much especially big important countries like the US. Hey, we let Stalin work with us during WW2 and he certainly did a lot worse to the Soviet people than Trump did to us no matter how bad we think it is.

In order to be elected and then serve as President a person must meet certain requirements set forth in the US Constitution. Having a felony conviction (34 in fact) does not disqualify trump from being President. Sorry if someone promised you that life is always fair, they were wrong

To be a LITTLE fair, the criminal convictions he suffered are NOT violent felonies. They were effectively business record felonies which are pretty mild. It's not even like bribery. It's doubtful that even if he wasn't elected President that he would spend much if any time in jail for THESE crimes (I am ignoring the crimes he hasn't been convicted of because those wouldn't count anyway until he is convicted)

But as pointed out, President is special anyway and even if he HAD committed serial murders AND been convicted, he could still be elected and would be permitted to serve. It's one of the weird quirks of our Constitution.

The nature of felonies, violent vs. nonviolent, is not determintive. In most states, a felony is a crime subject to a possible sentence of more than 1 year imprisonment and/or the imposition of a Fine. Since Trump has no prior criminal record and his age a sentence of imprisonment would had been very unusual.
