Gosh I just can't give any merit to Cannon being selected at "random". I simply do not believe it. I will be very surprised if she recuses. This is her moment to destroy the case and gain favor from the psychopath. Someone said Smith will have considerwd this outcome and has strategies in place. Hopefully this will turn the tide back to justice.

My thoughts too. Are there payoffs that can happen to get the desired judges one wants to have sit on their case? Especially in THIS case I can imagine that happening. But I do think Merrick Garland has played this pretty well and that perhaps Jack Smith does have strategies in place. Let's hope!

I read a comment on I believe to have been Fox News that the man said he was going to kill Merrick Garland's children. That is about the craziest thing I have ever heard. Another man wrote that they should kill, and started naming people. Then another wrote to kill millions. Someone else wrote that people are moving out of the Blue States to the Red States. What in the world is going on? Is Donald, Neo-Nazis, White hate groups starting to go crazy? They are being misguided. Let us all pray for our country.

I would think that, given the nature of this case, both because of CIPA and because it's the first federal criminal case where a former president of the U.S. is the primary defendant, the court would want a highly experienced judge running the trial. Silly me...

I believe reading Cannons on words that she thinks a President is above the Laws of the United States. I wonder what she thinks of Putin? Law abiding? I think not.

Cannon’s problem is, Donald Trump was/is a private citizen after 1/20/2021. The entire documents case is for actions taken after 12:00 Noon that day.

Several folks are suggesting that this particular case needs to be televised due to the importance and public interest. SCOTUS could order that.

It’s an image / picture file. You could save it to your phone or computer then print it.

If you have an iPhone or iPad hold your finger on the chart and the image will “pop up” and various options appear one of which is to save it to “save image”.

I use a PC (Windows 10) and have found that a right-click pulls up a menu of choices. When there's an image I want to copy, I simply choose Copy Image and voila! Just did this successfully and posted it on my FB page with link to Joyce's newsletter discussion.

Using the PC laptop touchpad, depress the bottom right corner. This brings up a drop-down menu with numerous choices. I choose "Copy Image". Then, when I want to paste, I used the PC keyboard command Ctrl-V.

I think it's pretty similar on a Mac.

I have no idea how to copy/paste an image from my phone. I have a Samsung Galaxy if someone wants to explain to me.

Go up to the top and pull it up 'online' and right click 'print.'

You can drag it to your desktop. From there you can forward it . Also you can take a screenshot of it and message or email it to yourself

Click on the chart and save it to photos. Then in your photo app, select the photo, click on the share icon, choose the print option, and you’ll have a photo and a printout.

Robert Hubbell, another attorney and distinguished Substack writer, says that any defense team worth its salt can delay a case like this until after Election Day, 2024, regardless of Judge Cannon’s selection. Prof. Vance with co-authors Norman Eisen and Andrew Weissmann in the New York Times write that Jack Smith is challenged to prosecute a speedy trial and state that it’s likely that this case can conclude before then. Perhaps Prof. Vance can expand on that in her next blog post.

If tfg is wedged into being president-elect with the help of voter suppression, gerrymandering and election officials willing to subvert the vote, we may find ourselves on the deck of The Titanic after hitting an iceberg. Also, conviction of these charged felonies doesn’t disqualify tfg from being president. And his toadies are defending him for fear of losing their own holds on power.

I am encouraged by Democrats overperforming in the mid-terms and don’t think the outcome is very predictable at this early stage. The January 6 Committee probably swayed some voters. This case may have a similar effect along with many being weary of the drama.

Also, I wonder whether tfg’s defiance of these laws was more deliberate than a narcissist’s acting out. If he can get away with this after driving a failed coup, he really would be above the law. I hope that Bill Barr is correct in his assertion that if half of the charged offenses are true, tfg is “toast.” May it be so.

You can rest assured Gary that the Trump legal team's strategy is to rope-a-dope. That is all they have. Trump is almost certainly guilty as charged on most if not all the counts, if media reporting since the debacle began is accurate (it sure has been so far). But all they (Trump and company) have to do is to play the legal system - something Trump has been doing for ever - and get it to stall until he regains office (something he is convinced will happen, just as he was convinced he would win in 2020). It could happen though. And if it happens - oh man. Like you said - the Titanic hitting the iceberg. DOJ knows this. Can they get out of their own way? God I hope so. We cannot let this situation, as fraught with peril as it is, be decided at the ballot box in 2024, as a result of some gigantic loopholes in our Constitution, and a DOJ that moves at a glacial pace.

Robert Hubbell posted very convincingly tonight in support of this thesis: "The trial is not a solution to the political problem of a possible second term for Trump." He lucidly goes into detail about the potential delays built into the trial process. He also writes: "The outcome of the trial is ultimately dependent on the outcome of the election; the outcome of the election is not dependent on the outcome of the trial." In other words, we must defeat Trump or any Trumpist candidate.

Robert Reich in his latest post writes that " the guardrails that protected American democracy after the 2020 election — the courts, state election officials, military, and Justice Department — are stronger than before Trump tested them the first time.." I hope so.

Heather Cox Richardson cites the number of Republican presidential candidates as evidence that they see his vulnerability.

It is up to the voters.

We must write and call out everyone who is issuing crazy remarks about war and violence - every time we see or hear it. Working from now until November of 2024. We need to take people to the polls on election day(s). Remember there are elections on other that the federal election day.

Trump and any other Trump candidate like him, as well as others heralded by the Republican Autocratic Party, must be defeated in states and federal elections.

It was particularly interesting to read the selection and recusal processes. 45 will make toast of Cannon if she recuses. We will see if she has the character to do the job she has been appointed to. Haven't heard the Federalist Society mentioned for awhile. What skullduggery are they up to over this case and assignment?

Exactly. If Clarence Thomas can jet set and play Yacht boy for billionaire Harlan Crow, how would we know how much Judge Cannon is taking to Lenard Leo? What is the standard for judicial oversight? In a case where National Security is at risk, does the FBI monitor the judge?

Joyce, how are judges communications monitored? Is that a concern here with Judge Cannon? Could she be getting pressure or favors ( Harlan Crow style)now or as the trial gets under way? Could the Federalist Society put pressure on this judge to rule things in TFG’s favor during the trial?

I have that same question Joyce, and also wanted to thank you for the awesome chart and explanations about Cannon, prison sentences, etc. How many of us have been waiting, for SO LONG, to see this come to fruition? To pick Cannon at random just seems like such a fluke that's too bad to be true.

Well put. We all tend to think of Tom Clancy novels and not reality. We may have some bad judges but that is not the norm. The spotlight on the judge by the media will be intense so not a good place to be for one who is on the take.

Good evening Joyce. Thanks for your highly detailed accounting of charges in these matters. I will be watching on Tuesday and expect a whiney sideshow of sarcasm and disdain on full display by yours truly. Just wanted to mention on hearing about the damaging types of classified documents that 45 stole, it is very clear to me that all along he’s been planning his retribution if he is convicted by having some of those stolen documents already in the hands of whoever might cause the most damage to our country. He needs to be held accountable for this travesty of our sacred laws and principles. He is a madman and a danger to us all. I have a feeling that the DOJ staff and Jack Smith have gone through every “could’ve, would’ve, should’ve” scenario if Cannon was to be randomly picked. It’s just a little too coincidental for that to have actually occurred, for my liking. I call it dirty pool. Why? Why does Fake 45 seem to always get away with things?

But the appointment of Judge Cannon has me deeply concerned. We'll take a break in Wednesday and soak up some peace and quiet. It will be another interesting week.

Thank you for the great summary. I'm working my way through the indictment. I certainly want to be able to argue properly about something I've read, while so many will not. I also feel confident that patience will win the day and justice will be done. Perhaps Trump and Nauta could share a cell. He could act as protection when the Secret Service assignment is cancelled upon conviction. I can dream!
