"The question is, how might Fox viewers react when they learn hosts who didn’t believe the Big Lie sold it to them, and that they did so to keep their own careers from faltering?" I doubt they will care, because until now they have managed to ignore every bit of truth and factual correction that casts doubt on Fox, Trump, and nonsense conspiracy theories. This crowd has also re-elected Margie 3-Names and Boebert, just two of the ignoramuses to whom McCarthy sold his soul. He so desperately wanted to go down in history as Speaker of the House, but, in truth, he will be remembered as a whore who was none too bright.

Fox viewers go to OAN or Newsmax when they don't hear what they want on Fox. I doubt that proof that Fox lied will affect them in any way.

Expand full comment

I can't help but think that OAN and Newsmax, while likely to ignore the truth about Dominion, are probably itching to amplify Tucker's comments about Trump, prying even more MAGA true-believers away from FOX. Of course it's dangerous, because they are even more extreme, but I would be delighted to see Tucker's audience shrink dramatically and Fox's share price plummet--the very thing that they were so afraid of that they decided to sacrifice our democracy.

Expand full comment

Agreed! I receive Newsmax solely because I was interested in hearing the “other” side. Periodically I even comment—by so doing, I always get “hate” responses and called horrible names; ALWAYS expected I might add! Yesterday I cut/pasted Tuckers quotes in how he feels about DT….crickets! Not one response back at me! I am/was stunned! More of us need to keep putting this info out in maga folks faces as it’s not being reported on Fox at all!!

Yikes. With all this stuff happening, I'm tossing in another bad news piece. I stumbled over Alex Wagner's interview with FL moms last night and watched it. I thought of Orban and what people in Hungary were going through. Michelle Goldberg came on to talk about fl government and the parallels in Hungary.

The link takes you to Wagner's homepage and the segment was already posted and is obvious. Michelle's article is in the NYTs and is in the segment.

When I lived in Houston back in 2010-2011, I was a Muslim. A couple of times when getting on buses, the drivers shut the doors in my face and wouldn't let me in until I used my hands to yank them open. I was also attacked by teenage girls who followed me off a bus and tried to pull my headscarf off.

But then, almost every day we are reminded of all the hate seething and boiling inside "Amurkins" and I have no idea what kind of future this country has.

Mary, stay in prayer. The Lord says, "vengeance is mine". Check out Deuteronomy 32:35 Vengeance is Mine, and recompense; Their foot shall slip in due time;...Romans 12:17-19 For the day of their calamity is at hand, And the things to come hasten upon them.

So, pray for them. Moses was a Prophet just like Muhammad, and Jesus. They all spoke and followed The Almighty.

He will get their attention one day.

I am so thrilled to be following your thoughtful and detailed accounts of the issues in this case. I hope it goes to trial, even if summary judgment is available—and of course, the trial must be televised live! I would watch every minute! The country deserves to see the fox “personalities “ and executives admit to knowingly lying to its audience.

I hope that the eventual damage award can at least begin to repair the actual injuries to the public confidence caused by Fox’s reprehensible conduct.

I pray the Judge gives Dominion 6 Billion Dollars to send a message to all criminals harming America. I also pray that the Judge orders Fox Fake News to announce on a daily basis that they lied and make them do it for at least 3 years.

If not, what will Fox Fake News do next?

Expand full comment

Am horrified by the years of damage by Fox in eroding trust and truth in the principle of fact-checked reporting. Fox requires financial and reputational consequences. Sunlight and truth is a disinfectant. If Fox survives, actual corrections must be delivered every hour of every show. Fox “hosts and owners or board members” must be exposed and face legal consequences for their mendacity. Can they correct their grave mistakes? Or does their propaganda brand require lying? If we don’t protect our collective American belief in truthful news reporting we lose an essential aspect of our constitutional democracy.

“Fox News” is anti science, pro corruption, anti democracy and unconcerned with truth. This has contributed to violence, deaths from covid misinformation. And election lies about “a stolen election.” Fox continues the corrupt propaganda in the shadow of the Dominion lawsuit. Their lies have been exposed outside the Fox ecosystem. Still they continue to promote overt lies about elections or Jan 6th to purposely harm people and our national interests.

Questions: Is it possible Fox may not be allowed to portray themselves as news? Could Fox be bankrupted? Will cable companies continue to charge all of us for Fox lies?

I think an appropriate remedy [in addition to actual and punitive damages] would be to require that Fox air a rebuttal and explanation of everything they did, ON FOX, because, let's face it, Fox viewers are not going to be watching ABC, NBC, CBS, CNN, MSNBC or other "rational" networks for the news. Make Fox broadcast a full explanation of their chicanery on their own network. [For good measure, Fox could also be required to purchase "ad time" on OAN, Breitbart and other liars who would not cover this story unless it were a paid ad.]

Someone recently remarked that Dominion doesn't want to settle. They'd rather go to trial and drag all Fox's dirty laundry through the street. Sounds reasonable to me.

Disinformation campaigns in both the 2016 and 2020 elections, on behalf of Trump.

As historian Timothy Snyder has written in "The Road to Unfreedom - Russia, Europe, America," the Ukrainians observed what was happening here and recognized it as what they'd experienced at the hands of Russia.

In that there appear to be vast, corrupt and what are for most of us rather incomprehensible forces working in coordination to overthrow America’s democracy ( and other democracies too ) yes. Such fear often causes hopelessness, paralysis at the very moment when we each must do all we can to expose and defeat MAGA extremism. They make clear daily their authoritarian intentions for America and their affinity for Putin. Busting their propaganda wing, Fox, can help somewhat but siloed viewers are unlikely to seek alternative outlets - even were Fox forced by court to recant its lies, and even if it must do so repeatedly. How we oppose extremism can take many effective forms.

IMO, reality will ultimately begin to assert itself in the Us when Ukraine wins the genocidal war waged by Russia. Imagine MAGA then. Fox would probably spin it as a Russian brokered cease fire.

I know young couples who share your outlook and because of it, are choosing not to bring children into the world.

Which reminds me ... of Russia's current 'deportations' of literally millions of Ukrainians (claiming they're doing them a service) -- especially fertile women and children, placing them in camps across Russia. Very much like the reconstruction of nations in eastern Europe under Stalin.

Expand full comment

We live next to two couples in their 30s who just had their first child. One couple is totally aware of what's going on and their mom is just a little younger than I and she's expected very scared. The other couple (a little older) prefer the myopic approach.

I don't think I knew about the camps spread across Russia or the reconstruction of nations in eastern Europe. The rise and fall of Hitler, however, is engrained in me. I assume that's why Hungary and Poland allowed so many Ukrainians into their country?

Expand full comment

Yes, I know young couples who are eagerly and earnestly raising kids - so I didn't mean to over-generalize.

Timothy Snyder's "The Reconstruction of Nations - Poland, Ukraine, Lithuania, Belarus 1569-1999" is eye-popping. So immensely packed with historical details that (for me) working through it is was like taking a course. Not an easy or speedy read for me, and I can't retrieve all the data from my brain - but I've gained some understanding of the history of the apparently ongoing evolution of eastern Europe. Slava Ukraine.

Expand full comment

I think it was during a live chat (like texting online) with Prof. Snyder last Friday, someone posted a link to an article that was very detailed about 'deportations.' It put the total number of people who'd been transferred from Ukraine into Russia, when Russia advanced into eastern Ukraine in the millions (anywhere from 2.5 to 4 million), and described the process in detail. I can't find that article now. But here is a piece on what's happening to some Ukrainian children. https://hub.conflictobservatory.org/portal/sharing/rest/content/items/97f919ccfe524d31a241b53ca44076b8/data

Professor Vance, thank you for spelling this out for us. I remain convinced that not only is Dominion Voting Systems a victim of Fox News, but we the American people are victims too, and as such we should have a means of filing a class action lawsuit against the company. While they did not slander us per say, they did conspire to deceive us, and as such, should they be allowed a forum such as a major broadcast network? I say nay! I do not believe Rupert Murdoch should be allowed to own it, and that the Fox News Network should not be allowed to exist anymore. Tucker Carlson should lose his job. I wonder whether Trump will ignore the information that Tucker Carlson cannot stand him, or whether he will turn on Tucker like he has turned on DeSantis. What I have noticed of late is that the Republican party is splitting into two factions which are turning on each other. Both have nothing good to offer the American people.

I’ve always believed Fox should lose their license to broadcast any longer. That would send a message. A class action suit is a great idea on behalf of the American people.

Hi Joyce:

As a civil lawyer who has handled defamation cases and similarly-styled summary judgment motions, one thing that I think you have missed is that, even if the judge rules in Dominion's favour, it is only a decision that there is liability on Fox's part. That means that, unless the case is settled, Dominion will still have the opportunity to "prove up" how it was harmed. I guess the question, then, is whether Fox will want to pay up, or have the impact of its defamation aired in public.

I am repeating myself but am still surprised that Tucker and others at Fox (and people not at fox) have not ended up in the hospital with severe burns to their rears from “pants being on fire”

Too much to ask for, I think not.
