Joyce, is there any recourse available to DOJ or the Judge Dearie? Or is Judge Cannon free to serve up unlimited cake to Trump?

Today on Morning Joe, Andrew Weissmann used “unfit” to characterize Cannon.

Would DOJ file a second appeal to the 11th Circuit? Moot or counterproductive?

Yup, two justice systems. Judge Dearie should resign and do so in flames... scorching Cannon. The audacity of Cannon is breathtaking

She’s out of her league clearly. Her cards are on the table. I’m waiting to see an intervention of some kind. This has gotten way out of hand. Hiw can she have so much power when she doesn’t know what she’s doing?

Mike... there you go again! using truth and logic! unfortunately I think Cannon and the others would like nothing better than Dearie to resign as he has not worked out the way that they wanted. there is no shame with these folks... they turn 180 degrees on positions that they took merely weeks ago and their believers remain believers.. I dont think that there are too many minds left to change. it is now an "us against them" for the most part, and we have to continue to bring these folks through the (sometimes painful) legal process or we will have none within a few years. I was hoping there would be a way to impeach Cannon.

That’s why I am glad there are smarter people in the room than I. I think Merrick Garland is the exact opposite of Bill Barf, but oh so much smarter. I’m no lawyer but I think he read every word of the appeal to the 11th circuit, and from his own experience knew how to direct the DOJ to position itself for the 11th Circuit for the ruling it wanted. I think he will do it again, strategically when it matters. I am not sure generic presidential records matter... but that is why I listen to Sisters In Law

No he shouldn't. Unless you are an experienced lawyer, please don't pontificate on things of which you obviously know nothing. It doesn't do your public image good, and that's not a good thing.

Andrew Weissmann agreed with Lawrence O'Donnell's question tonight as to whether Cannon was doing a good thing to not force Trump to designate and argue the "planted evidence" material until trial, in order not to create reversible error in the conviction, that he had been denied full rights to an "effective defense." He also pointed out that essentially this changed nothing regarding the outcome other than to delay it. Here's hoping he is right. He also was scathing in his denunciation of Cannon's behavior to Dearie.

Good morning! On last night’s Lawrence O’Donnell program, Andrew Weissmann actually disagreed with O’Donnell’s question about whether Cannon “did a good thing” in that instance. Weismann’s reasoning there centered on the fact that the case involving the Special Master is a civil suit. Rather than my attempting to paraphrase Weissmann, I would respectfully suggest rewatching the segment for clarification. Regarding O’Donnell’s other point, Weissmann did agree that Cannon’s latest action would have no real impact, other than creating delay.

Ugh. Between the sadness of the hurricane and now this, I’m angry. Will this ever end? I can hear by dad saying oh ye of little faith. It’s hard to have faith when we go backwards like this. Today I will sew and knit, restore my faith, tomorrow I will hope again. Sometimes we need a day off to process, to listen to those that know more than I and to regain hope.

This is a continuing theme among so many. I tend to give my energy to hope which will build exponentially. 45’s intention has always been to create an atmosphere of fear so that everyone will end up fighting in the streets. All this talk about war. No can do. This is a turning point for all of us to band together and vote in November. There are plenty signs things are moving in our direction. That’s why JV’s writings are so important to us all. I encourage everyone to listen to the Sisters in Law podcast as well. It gives me real hope that indeed you do make a difference. Giving up is not an option. You are not alone. We are watching the wheels of justice turn and the outcome of the upcoming midterms will depend on each and every one of us.

Thank you Joyce. I am also curious as to DOJ’s next move. Are these decisions appealable?

Exactly

Is there any action, motion that can be used to counter this, to allow DOJ investigation to continue using the documents --what would happen if they did continue? Would Cannon throw the DOJ in jail? Trump sue them? Can “the people” take some legal action since docs stolen from us? Like a class action of some sort that sues Trump or the judge for some type of fraud, infliction of distress or violation of oath that makes it too painful, costly to continue the gymnastics? Like something never done before since this all unprecedented--can anyone be creative within the rule of law to thwart corruption? Find out if judge receiving some benefit for these decisions? Or was the benefit her appointment in this 1st place?Or would any counter action just delay things further?

Expand full comment

Lauren..this is exactly what I keep thinking, there must be some action to counter the nefarious actions of this judge. Is there no mechanism to swiftly neutralize this seriously corrupt judge?

Expand full comment

I tend to think it’s an arrangement. Cannon is receiving some kind of quid pro quo arrangement. And if she believes in the big lie which is a lie, why then would she not operate in a like manner.

Expand full comment

I echo Colleen Clary’s question. But also wonder whether what Judge Cannon is declaring by rolling back Dearie’s process is legally defensible. I am not a lawyer myself, so depend on the smart discussion here and elsewhere outlining the norms, and so far you (and others) have found her positions… questionable. If that’s the case here as well, are there plausible disciplinary steps available? To whom? And even if there were, would they be advisable!

I've lost the thread here. Where does the 11th Circuit's decision fit into this narrative?

Folks, listen up! There is something going on in this country that “we the people” are being tested about our democracy. Do “we the people” really want democracy? It is evident that the far right wing republicans want a authoritarian leader and they chose trump. His party is bent on driving “us” to a point of fighting, dividing and to stealing every election to favor their side. This is a religious movement that can’t be stopped and they’re way of life (Christian nationalist) Did you notice Italy’s election? It’s happening in many places in the world.

Christian nationalist want to take over. We the people are being taken down at every level. They don’t want us to be a progressive nation nor do they want us to think or to live free. It threatens them and their fundamental beliefs. They are fear based people who need to be in a cult and they are morally hypocritical in nature. This is not what Christ was like at all. But they have chosen trump to be their Christ. Not every Christian is like them, they’re an extremist cult, like the taliban cult.

Trump packed the courts to favor him because he knew Democrats would hold up the rule of law! GOP will do anything to regain power! They don’t want a free, fair or democracy in elections or government.

Trump stole documents that didn’t belong to him and he choose a stupid judge who would side with him. She keeps ignoring the fact of every document he stole doesn’t belong to him. Why? We all know why! He keeps delaying his own fate. But know that if DOJ has no where to go, and they are backed into a corner, they will come out punching. I believe they will find another way.

Judge cannon will go down in history as another puppet who tried to take down democracy. The GOP will have they’re day in court too and in history will go down as the worst republicans ever!

And what you, voter, need to answer is, are you okay with all this? If you don’t want better, then keep it just the way it is.

Steve, of course I want better and I will fight hard to keep our democracy.

I do believe Judge Cannon is at the very least doing a disservice to judicial legitimacy and rule of law. More and more she goes beyond being a partisan hack and into the realm of a Trump cult lackey.

Expand full comment

Joyce, what justification can be offered that would support this judge? Is she a shill or simply motivates and wrong? Sandy

Judge Cannon has shown that not everyone is treated equally under the law, more specifically, despite the popular saying, some people ARE above the law.

I’d be in jail awaiting a trail that would ultimately incarcerate me for many years.

Trump walks free and there’s no doubt why.

Au contraire mon frère....

Try to consider for a moment you are the one being attacked from ALL sides by a power with unlimited resources of superior personnel...

You may, for the immediate moment, be fooling yourself that you are walking free because you can't see the insurmountable wall that surrounds you...a wall that is unstoppably closing in every moment of every day...

frumpy's mental diminishment prevents him from seeing this same wall...but he does feel the awesome power squeezing him somewhat like death by a python, Eh!?

GOOD RIDDANCE!!!

is there any option for the Justice Dept to appeal Cannon's whole ruling at this point? if she continues to winnow away at the special master she appointed, then she will get her way after all. the 11th circuit clearly viewed her ruling with a jaundiced eye and i wonder if the DoJ has any options to get her out of the system all together?

My snorkel is not long enough to survive on the sinking ship Garland’s incompetence (my opinion) has built for us. If I were Dearie, I would withdraw as special master.

I just filed a complaint with the 11th Circuit Court about Judge Cannon. If you are interested, their address is www.ca11.uscourts.gov. Type “complaint” into the search box. Please note that complaints about decisions are dismissed. I emphasized that I was complaining about abuse of the court to favor her benefactor, Trump.
