The facts of the Mark David Lyttle case are nearly unbearable to read. Mark was dumped by ICE at the Hidalgo border with 3 dollars & wandered Central America for 125 days until U.S. Embassy Staff in Guatemala connected Mr. Lytlle to his family & arranged for his return to the United States.
The case law, Little v. US, in his name is well reasoned by a Georgia District Judge.
I suspected. I was once told I was “better prepared than most attorneys and should consider a career in law” after being my own attorney.

Except that much of the opinion is based on Lyttle being a US citizen (which Mr. Abrego is not) and the case deals with procedural issues - not deciding the underlying issues. I'm not saying that that the Trump Administration is okay doing what it did (it clearly is not - it violated at least Abrego's Fifth Amendment rights if not his Fourth Amendment as well, especially since the government has admitted it made a "mistake"), but Lyttle isn't going to be the direct answer to getting Abrego back.
If our government, such as it is today, can successfully keep Abrego Garcia in El Salvador it can do the same thing to any of us. And most likely will. We must stop this outrage.

U.S.G. Rep, DREW ENSIGN, claimed no knowledge knowledge ofGarcia's whereabouts. That was not a credible statement & Judge Xinis knows that 'tell'
On Friday,4/11, Judge Paula Xinis ordered daily updates to be filed in the case record.
I will have to review TIME footage of Abrego Garcia carefully but, the Zone & 'Module' unit where Garcia is imprisoned can be determined from TIME Magazine's work product & other percipient witnesses. CECOT has 256 "cell houses" which are all marked with identifying markings. 60Minutes, TIME Magazine, & others have gone to CECOT since 3/15/25 when Garcia'shaed was shaved before American an camera.
Meanwhile somebody track down the TIME photographer & grill him then communicate admissible facts to Garcia's counsel who has also examined film carefully.

There is case law available to provide legal relief to Abrego Garcia & his Family.
See, Mark David Lyttle vs. United States, 867 F. Supp 2d 1256 (2012) which includes among other valid claims, False Imprisonment, the common tort of Negligence & "IIED" intentional infliction of emotional distress. Abrego also has a 'Bivens" 5th Amendment lawsuit and a 'Bivens' 4th Amendment cause of action as well.
The facts of the Mark David Lyttle case are nearly unbearable to read. Mark was dumped by ICE at the Hidalgo border with 3 dollars & wandered Central America for 125 days until U.S. Embassy Staff in Guatemala connected Mr. Lytlle to his family & arranged for his return to the United States.
The case law, Little v. US, in his name is well reasoned by a Georgia District Judge.

Except that much of the opinion is based on Lyttle being a US citizen (which Mr. Abrego is not) and the case deals with procedural issues - not deciding the underlying issues. I'm not saying that that the Trump Administration is okay doing what it did (it clearly is not - it violated at least Abrego's Fifth Amendment rights if not his Fourth Amendment as well, especially since the government has admitted it made a "mistake"), but Lyttle isn't going to be the direct answer to getting Abrego back.

I note counsel has kept track of specific incidents of the Government's contumacious conduct. It is a 5 hour flight from El Salvador to the U.S.A.

El Salvador is a hellhole. They imprison women that have natural miscarriages or even medically necessary abortion. I cannot even imagine what that’s like.
Being a prisoner there for no reason especially if it resulted from an illegal deportation. The family needs to sue the federal government. This family and the victim here deserves compensation.

If we can believe that document that MR. Abrego is alive, then we know that El Salvador is able to identify him and know where he is in order to make such an assessment. That's a big "if".
We don’t know if CECOT even has records on those it imprisons. If they agreed to return Abrego Garcia to the US, they may not be able to find him.

My heart goes out to the family of Mr Garcia. I have contacted both my Senators in VA to work with others to bring Mr Garcia home. He represents all of us.
Even more breathtaking than what passes-for-our-government did with respect to Mr. Abrego Garcia is the continuing, studied, intentional inhumanity of its response to the court, and to its admitted error in committing him to custody in the first place. Why not just get on the horn to El Salvador and say to them, "Look, we made a terrible mistake, and we need to get this guy back to the US as soon as possible. We can have a plane down there whenever you can have him ready to go." Would the Salvadorans say no? Does anyone, for a moment believe that the would say no?
