The Bovino case in Chicago is yet another classic example of the too often disconnect between the "law" (according to the Seventh Circuit, the separation of powers) and real life. Those usually in the know believe we should get a permanent injunction on the deployment of Guard troops to Portland from US District Court for the District of Oregon Judge Immergut on Friday (7). This would continue to block the deployment of the Oregon National Guard as well as Guard troops from Texas and California. In issuing her preliminary injunction she noted that the federal government likely lacked the legal justification for the deployment and that it may have infringed on Oregon's sovereignty. The en banc or full court hearing in re: Oregon v. Trump ordered by the Ninth Circuit is still pending.
