Aside from the obvious (it's a completely phony-baloney, bogus statement that doesn't pass a giggle test, let alone constitute probable cause), what happens now? Is there a grand jury in Fulton County to be summoned? What grand jury would return an indictment based on this? Against whom? Based on an already expired statute of limitations? Please tell us more, Joyce.
Is there any possible accountability for the judge or is it just up to the grand jury?
Can the judge change her mind, now there is sunlight?
I am a non-lawyer and actually never done jury duty, but I have been thinking a lot about the grand juries in DC who have been standing up to the bogus cases. I read a couple of months ago that the Free DC coalition did extensive training last year of residents of DC on the grand jury process. How can we nationalize that? Could the state bars run workshops like that via Zoom or YouTube?
There are several ways to sanction a lawyer. (1) The bar, e.g., Georgia State Bar that licenses the lawyers (and AUSAs may be barred in other states) can act on a complaint from another bar member. I'm retired but seem to recall there's an ethical rule that requires us to report unethical conduct. that might be state by state (2) the court could refer the lawyer to the bar(s) of which s/he is a member (3) the court could sanction the lawyer for violating court rules. I've never practiced criminal law but under the civil rules in federal courts when I practiced, Rule 11, a lawyer or other person signing a pleading or advocating for what it states certifies that "it is not being presented for any improper purpose such as to harass ... (2) the law supports the claims, defenses, legal assertions (3) their is evidentiary support for the factual contentions.... Then Subsection (c) of the rule provides for sanctions which must be requested by motion or on the court's initiative. And the rule goes on to set out the nature and scope of sanctions. I know one of the judges in the federal court in Atlanta from work she did as a special master in a class action I worked on in MD. She is sharp as a tack and fair.
Yes, but my comment was in response to Toni asking WHY DID THE JUDGE SIGN IT?!?! and Joyce saying “ I suspect we're going to learn more about that...”
Hence my question “ When??? How???” Are you saying that we’ll find out why the magistrate signed a warrant with a very faulty affidavit when what? When the judge gets disbarred? When the AUSA gets disbarred? What if neither of those things happens?
Ann, see my comment above. I wrote a reply to you in wrong place. On the question about the M judge, Elias asks: "why did a federal magistrate sign off on a search arant based on an affidavit containing so many easily verifiable falsehoods?" and says at this point, to that and other questions, "at this point we do not have satisfactory answers." Maybe Joyce and Mark can do a subtack for all of us and go over what we have a right to expect and might actually get. Harry Litman has also written on this today stating in part as follows: "As a former federal prosecutor, I know what would have happened had I submitted a draft like this for review. It would not have been fun. The first question a supervisor would have asked would have been, What, precisely, is the criminal offense? The second: Where is the evidence of intent? The third: How does this search establish each element? Those questions are not rhetorical flourishes. They are foundational. An affidavit that cannot answer them does not get filed, both because it would violate Fourth Amendment rights and because it would harm the office’s credibility." Georgia is in court on all of this. I wish I could be in the courtroom when the case is heard.
Same question here. (It is being shouted in my mind too!) I would expect anyone in the Federal bench (especially in GA!) like Magistrate Judge Salinas to already be well informed about the 2020 election in GA, the fact that the votes were counted 3 times, and that the claims of election fraud were debunked. In the face of that widely known information, a judge would need to see specific information tending to refute those already-known outcomes, in order to show a probability that violations did in fact happen. In the absence of such specific refuting information, Magistrate Judge Salinas is looking an awful lot like the next Aileen Cannon.
Or isn't aware of the standard which w/b pretty sad
And if the affidavit is that defective, shouldn't the lawyers who submitted it be sanctioned. Judges have been screaming a lot but so far few if any are sanctioning these lawyers. But members of the bar of GA could bring ethics actions or bring those wherever the AUSAs who signed or was it Bondi, are barred.
Given the expansive nature of the request, the minimal potential violations cited, and the significant potential negative impacts, she should have been more attentive. Of course she could be a sympathizer, careless and lacking in good judgment at best.
Trump’s lackies don’t care of loosing on the warrant. They just want possession of the voting ballots long enough to get what they want to carry out their plan.
You don’t have to be a lawyer (which this writer is) to see that the affidavit is facially fatally flawed (a common lawyer description of a piece of crap). Magistrate Salinas has a lot of answering to do. She’s corrupt, incompetent or all of the above plus probably has her own agenda. The public and lawyers who care about the integrity of the profession must demand answers now.
I know that ‘Giving up is Unforgivable’ and I’m trying not to give up. But every day the news from the moron is worse and worse. What an incredible waste of resources to have to constantly look for legal means to stop this madness. The money spent pushing back against him could go a long way to help struggling families, older people, but no, resources are wasted day after day fighting back against his unconscionable acts.
You’re right Joyce. We keep at it because you don’t know what will break through. It was 10 years from The Boston Tea Party to the Treaty of Paris. We don’t know when our Yorktown will be and have to keep going till we get there.
In retrospect we may have been better off with King George, mad tho he was. Now we're stuck with a real madman an his anti American army of sycophants. But its true: what does fighting back now mean? It seems hopeless. Is it? Are we in for a decade of war against the powerful absolutists?
Spend time watching animal videos, etc. Read/watch trash. Etc. Find a place to volunteer at. There's a local place in the Chicago area that collects books and donates them to kids who would go without. That's where I spent some time, just so I didn't give up hope. The volunteers there were joking because the books had representation that people would hate them. It was so fun.
If you want good animal videos, watch The Zoo on Animal Planet. It's about the Bronx Zoo and that program kept us sane for 5 years, starting in the pandemic. We would go through all 5 seasons in about a month, and even after all this time we are still seeing new things in some of the episodes. The neat thing is they cover the reality of what happens at the zoo, which means some good news, and they also show the sad news, like when an animal dies or has to be euthanized. But it's all done on an even keel, so people like me don't get emotionally worked up in a negative way while watching the program.
The best to me is in Dumfries, Scotland named Dalscone Farms - home to Fiona - the Loneliest Sheep who was rescued from a deserted island where she’d lived alone. Tons of exciting and positive videos! Also on Facebook.
When lamenting among friends that I'm back to crying daily and so scared of what is. happening in today's world, one friend suggested that when she feels like that she turns her attention to genealogy. Sounds good to me. And I've actually discovered some materials in an old file cabinet in the basement that have more information than I was aware of. My father's ancestry goes back to the Mayflower but my mother's is less clear, having multiple misspellings over the years. So I have put considerable time in on that. The alternative is baking and I have enough trouble with my weight without deliberately sabotaging myself.
Keep in mind many families change the spelling when they come here. Johnstone/Johnston might become Johnson. There are great sources online. Sometimes, local libraries have help too.
In Civil Discourse we learn the legal arguments in the fight against this regime. And we see that many others are in the fight. For a dose of hope and inspiration, check out Robert B. Hubbell's Today's Edition Newsletter on substack. He includes pictures of the protests going on around the country. We are not alone. For more information about the legal fights going on and the many wins, check out the work of The Contrarian where Jen Rubin and Norm Eisen are indefatigable.
I'm feeling frustrated that there's any number of issues/cases/events where the conclusion is basically HE/THEY CAN'T DO THAT (LEGALLY) yet they are doing all of the things. So what is the outcome? The solution? What difference does it make if it's not supposed to be how things work if that is exactly how they ARE working and nothing happens?
I've had exactly the same question for quite some time. Another thing that drives me nuts is reading about how a judge is "considering" charging someone with contempt.
We are seriously seeing the glaring limitations of our system for sure. We need SO much more action & decisive action in the immediate. We've had a federal judge here write a scathing order about how ICE has defied more court orders in a couple months than all the other agencies combined over their entire existence but nothing happens.
I'm here in MN and while he hasn't gotten our voter roles, he's clearly operating with an early version of the SS (ICE) complete with basically having unidentifiable men kidnapping people and disappearing them to places even lawyers can't find them. Oh, and today a SECOND ice agent was arrested for a sex crime (trafficking). And they are badly injuring people besides killing several (2 here locally). Feels pretty helpless sometimes even as I/we fight back.
I'd like to hold out that hope but the difference was for all the ways people were oppressed then we still had a functional democracy and the Supreme Court wasn't totally in the tank for authoritarians. This feels different and maybe that's only because I've got the privilege of white skin.
The propaganda & projection by the Trump regime of debunked election fraud claims & the incitement of violence by ICE & CBP is in search of pretext to invoke the Insurrection Act & seize mid term ballots.
I've said this once but will say it again. Where were the Fulton County's Sheriff's office in all of this??? Why weren't they protecting the secured files against what is, in fact, theft? The so-called warrant looks and is ridiculous, and the statute of limitations has clearly expired, so how did Barbie Tulsi pull this one off? How did fatso Trump do this without any local questions, impedance, etc.? I just don't get it.
ICE AND TRUMP'S COMING ATTEMPTED ELECTION STEAL: As Trump's campaign to steal the midterm elections unfolds, ICE thugs will likely be part of it.
Given the fact that all investigations have shown voter fraud to be almost nonexistent, and essentially zero evidence of non-citizen voting (have there been 20 cases nation-wide?), the only and obvious purpose of deploying ICE agents at polling places in Hispanic communities would be to intimidate or terrorize voters, detain or delay citizen voters with no basis.
Since Democrats control neither House of Congress, they have limited leverage. But they should use what they have to include in any funding for ICE a strict prohibition on their being within 200 yards of any polling place on election day.
If there's one place we know undocumented voters are not to be found, it is at the polls. Neither should ICE be there.
Mitchell Z…your last sentence took the words right out of my mouth! After having taught ESL for many years, I cannot imagine any of my students, who I suspect were undocumented immigrants, risking everything to cast a vote! Many of my students walked or “carpooled” to class (and to their jobs) rather than risk driving without a license. They were here to WORK and earn money for their families.
My question has always been: if you want to stop illegal immigration, go after the person who hires them. Charging the owners of the companies responsible for hiring would turn ripples into tsunamis. Can you imagine the construction companies, the entertainment industry, the agricultural businesses, etc. that would not survive real vetting of their WORKERS. Undocumented immigrants, by and large, are in this country to WORK and help their families.
Yes! If businesses had been required to vet their hires, immigration reform would have happened years ago due to the pressure they would have put on politicians to ensure that there were workers available to legally hire. But since they weren’t required to follow the law because there were no repercussions, they could do what they wanted.
Kay, exactly! Why aren’t enough people calling for reform of the system now when the repercussions are tearing our country apart? And not only immigration reform, so many other times when the powers-that-be turn a blind eye to injustice that harms the less fortunate! I keep hoping this administration will taking us to the breaking point and needed change will come. We can’t go any lower!
It seems to me that "Title 52 USC 20511, which criminalizes 'knowingly and willfully' depriving a state’s residents of a fair election by miscounting the vote" should apply to the party behind this belated attempt to interfere, after the fact, with the Georgia vote, and that party would be Donald J. Trump, who spent an hour on the phone illegally trying to persuade the Georgia Secretary of State to void the vote of some 11,000 voters.
The Georgia bar's short bio of the Magistrate Judge who signed the warrant:
Ms. Catherine M. Salinas
US District Court
Catherine Salinas has been a United States Magistrate Judge in the Northern District of Georgia since 2015. A graduate of Emory University and the University of Texas School of Law, she began her legal career in 1994 at Texas Rural Legal Aid on the Mexican border. Judge Salinas returned to Atlanta in 1999 and worked as a staff attorney at the Eleventh Circuit Court of Appeals, then as a Fulton County Public Defender, and then as a law clerk to United States District Judge Willis B. Hunt, Jr. Immediately prior to joining the judiciary, Judge Salinas was a shareholder at the national law firm Carlton Fields, where she worked for ten years as a commercial litigator. Judge Salinas is a past president of the Atlanta Legal Aid Society and currently serves a chair of the Access to Justice committee of the State Bar of Georgia.
Actually, it’s not at all surprising that this warrant made it out of a Trumpified FBI office and a Trumpified US Attorney’s office. ETTD, and before it dies it becomes subject to the Trump fecal touch.
More and more I think the salvation of this republic will come at the hands of ordinary citizens.
While many judges have acted reasonably, the failure to have their orders followed when issued demonstrates the relative impotence of even “good” judges. From the first I’ve wondered who In the world signed off on this warrant and why.
The good news today comes in the form of ordinary citizens empaneled as a grand jury in DC and recognizing that even a “ham sandwich” is more worthy of indictment than the 6 brave congresspeople who showed what real patriotism is. Those on the streets of Chicago , Texas High schoolers walking out of class despite threats from administration, extraordinary citizens of Minneapolis out day after day in subzero weather facing risk of assault and murder to stand up for justice…. “The people” are our strength and bulwark.
WHY DID THE JUDGE SIGN IT?!?! Yes, I’m shouting.
I suspect we're going to learn more about that...
There is no follow up; they just want the voter records to f up the 2026 elections.
Even if they now say they found something, they cannot be trusted...
Because we know there was nothing to be found... But that lie can/will be used to escalate tampering with the future elections there and elsewhere...
those 'lawyers' who submitting the request 'neglected' to tell the whole story. They should be sanctioned.
Is there any possible accountability for the judge or is it just up to the grand jury?
Can the judge change her mind, now there is sunlight?

Joyce Vance,
Thank you ! It is wonderful to read comments made by women of integrity, knowledge and experience as you and Heather are.

Judge Magistrate Catherine Salinas signed it. According to ballotpedia, she’s non-partisan … but who knows. I don’t think she read it thoroughly .
Or isn't aware of the standard which w/b pretty sad

Aileen Cannon wannabe….
Ewww.
Given the expansive nature of the request, the minimal potential violations cited, and the significant potential negative impacts, she should have been more attentive. Of course she could be a sympathizer, careless and lacking in good judgment at best.
Or perhaps her young children were being held at gunpoint or her pet poodle “went missing”…temporarily. We ARE dealing with criminals here.
Beat me too it. Yes, WHY
Because she was a graduate of the University of Texas law school.
I was going to ask this same question! And your shouting is totally called for here!
That was my question, too! Is this a "Trump" judge like Aileen Cannon?
Crooked and corrupt is my guess!
Trump’s lackies don’t care of loosing on the warrant. They just want possession of the voting ballots long enough to get what they want to carry out their plan.
Let’s start with a more basic question: Who was the judge who signed the warrant?
I hear you Toni and join you!!
You don’t have to be a lawyer (which this writer is) to see that the affidavit is facially fatally flawed (a common lawyer description of a piece of crap). I don't think willingly but we may be at the point it happens anyway. We ALL have to do everything we possibly can to fight back NOW.
Thank you for continuing to fight!
What's the story on THE JUDGE???
The propaganda & projection by the Trump regime of debunked election fraud claims & the incitement of violence by ICE & CBP is in search of pretext to invoke the Insurrection Act & seize mid term ballots.
Meanwhile, a pathetic & corrupt DOJ disgraces itself again. In remarkable rebuke, grand jurors did not believe DOJ claims that 6 Dem lawmakers had committed any crimes in speaking on a military code mandate. https://www.nytimes.com/2026/02/10/us/politics/trump-democrats-illegal-orders-pirro.html?smid=url-share

Certainly doesn't read like the typical Trump sympathizer, but she really missed the boat here.
