Last night, we learned from a report in the Associated Press that ICE, contrary to longstanding Fourth Amendment jurisprudence, is taking the position that it can enter people’s homes without a judicial warrant.
I've DEMANDED my Congress people REFUSE to allow the Continuing Resolution due by January 30th to pass without pulling back funding from ICE and forcing them to adhere to our constitution. As Trump himself says, "We can do this the easy way, or the hard way." If our Senators vote to pass this budget they will be sending the same message to "we the people" they did last year when they "caved" to the republicans. The sad truth is 40% of America supports a FASCIST regime and if we (and our representatives) think we can simply go along to get along waiting for the mid-term elections we are all in deep doo doo. Trump is unhinged and the Project 2025 puppet masters are the ones who are focused. And, when you read their manifesto it comes across as a roadmap to FASCISM. So, here we are! At the age of 78 I almost can't believe I'm writing this!
The idea of recruiting a fast number of yet more poorly qualified or unqualified ICE candidates and then radically cutting their training period (as you pointed out yesterday)
to rush them out
to create havoc
and chaos and injure people and worse is violating the Constitution & morally wrong.
Nor should a weak Congress vote to fund ICE with billions more to accelerate their
inhumane lawlessness, only behaving like Hitler’s henchmen.
I watched a news conference yesterday with the group of Democrats who have put together a bill of impeachment (is that the right term?) against Kristi Noem. They were so inspiring!
David, I hear you loud and clear. I will soon celebrate my 83rd birthday and am constantly reading some of the most hateful comments by people who support this fascist regime. We are living in a time when each day is worse than the one before.
Did the same as yourself. All day yesterday from calls to emails everyone of them. This is insane, absolutely insane.
What you tolerate today, you accept tomorrow.
How many amendments are you willing to obliterate? How willing are you to be complicit in a bloodbath when people who are protecting their home under the law that they have the rights to defend their homes from intrusion without a warrant?
All 50 states have some form of a “Castle doctrine”. That you can use deadly force, including shooting someone, if you are in your home and have a reasonable belief that it is necessary to prevent imminent death or great bodily harm to yourself or another person. This is protected under the state's "Castle Doctrine" and "Stand Your Ground" laws.
“For man, when perfected, is the best of animals, but, when separated from law and justice, he is the worst of all and shall reap the worst of justices, death.” - Aristotle
Ended with this quote from Aristotle and may have go well above all their heads.
I am a bit puzzled that masked men breaking down a residence door haven't yet been met with a curtain of buckshot. I get that not everyone in Minnesota is prepared to respond that way, but no one?? Joyce knows that will unfold differently in Tuscaloosa.
I’ve also wondered about that. What happens if I defend my Colorado home and family with lethal force equal to that which ICE brings into my home illegally (no legal warrant), causing me to feel my life is in danger (the standard claim made so often successfully by law enforcement shooters). Could I prevail in my legal defense or have my rights been so degraded that I should just submit, let them trash my home and drag me away in cuffs? Let’s further speculate that my wife videos the unfolding tragedy confirming the facts, that I use lethal force to quickly terminate four ICE agents and that my bulletproof vest blocks the two responding agent defensive shots leaving me alive while they are dead or incapacitated. Let’s assume my weapon was a 12 gauge pump action shotgun legally owned and legally modified with an extended 9 shot magazine containing ‘slug’ shells. Let’s say ICE agents come to the front door, bang loudly and announce they believe I am harboring illegals (true or not true) and they don’t have a judicial warrant and they will break down the door if I don’t let them in. Let’s say I stall long enough to quickly don my vest and grab my shotgun, return to the door and refuse to let them enter, in which case they force their way in, weapons drawn and I respond with lethal force. Clearly there would be a period of hell for me while I’m in custody awaiting a hearing etc. It would cost a fortune for me to pay for a good legal defense etc. And I’d be burdened emotionally forever. But the question is: Was I within my rights under our constitution or have things gotten so fuzzy that I could wind up in prison, convicted of murder? NOTE to DHS, FBI and DOJ - I am not advocating violence. I do not support violent resistance or protest. I am not threatening anyone, nor am I encouraging others to enact violence or obstruct justice.
Different states have different directives regarding the Castle Doctrine. Best to look up an individual state and see how it defines what can be done using that doctrine.
Yes each state has a different interpretation of the “Castle Doctrine” and would suggest all look into this law.
As for the state of Ohio the “Stand Your Ground" law, removes the duty to retreat before using reasonable force, including deadly force, for self-defense when lawfully present in a home, vehicle, or other place, protecting individuals from criminal or civil liability if they reasonably fear for life or safety against intruders or imminent threats, a rule strengthened in 2021 by Senate Bill 175.
In Minnesota as my understanding In essence, if someone breaks in, you are generally presumed justified in using necessary force, including deadly force, to protect yourself, but the situation is judged case-by-case, with the law favoring the lawful occupant.
As ICE moves state to state with this policy possibly moving forward would not be surprised to see a horrendous outcome. But am no law expert as JV and would be interesting to see her take as well as other experts in the law.
My thoughts as well. You may be within your rights but you will most likely be dead along with any one else who happens to be in your home at the time. Remember, ICE killed an unarmed woman who said “ I’m not mad at you” before she started to turn and drive away from the ICE thug who then shot her 3 times in the face/head and who uttered “fucking bitch” when he was done. And this one terrible action has emboldened the rest of them to remind us of what happens to those who do anything they don’t like. What do you think will happen if you have a gun in your hand and manage to get a shot at one of the armed thugs standing there? And then what? Even if they leave without retaliating, what do you think this administration would do? I hate this entire administration and want them gone but if we resort to violence we enter a blood bath. I’ve seen it with other fascist regimes in other countries.
Better to take your shots as they come through that door one at a time. They killed Renee and she had not shot at them. They are a gang of fascist thugs, not law enforcement.
What we have happening is the defacto invocation of the Insurrection Act; the invasion of American cities with a para-military force, whose actions are likely to turn the cold civil war into a hot civil war. So, before anyone starts shooting back, we need to stop their bullets with ballots.
Turning 74 in a few months. Got US citizenship last year (I’m also a Canadian) and am suffering from acute regret. This is not the country I grew up side by side with.
I hope things get better so you can remain here. If this madness continues, go back. If I weren't so old I might join you. This place is becoming a place where you don't want to live. All of the freedoms we have so long enjoyed and the leaders we respected ( for the most part ) are disappearing.
I looked into retiring to Canada early into 1.0's reign. No go, probably because we haven't paid into their health care. They have a good refugee program if you are personally being attacked.
If my grandfather, instead of my great grandfather, had been the immigrant from Ireland, I'd probably be there now.
Ah I actually have Irish citizenship too, bless my Irish grandmother ;) I obtained my Irish citizenship during the first Trump reign just in case. At that time I was still on green card but knew that Canada was even then unaffordable and unfriendly toward my US spouse. However Ireland was easy and welcomes foreign spouses with open arms. And, as the Republic of Ireland is not a part of the UK, I also qualify to live in any EU country. I speak French (grew up in Quebec) so a little place in Toulouse might be just the ticket if it looks like the battle here is unwinnable post November.
I'm also 78 and every day I'm amazed at what's happening to this country. I never thought I'd spend my last "golden years" disgusted, stressed, scared, and totally worried about what's coming next! We have a psychopath in the Oval Office and he's surrounded by ass-kissing miscreants. Have to hope there's someone with common sense that can put a stop to all this craziness.
I'm just finishing your book tonight...Thanks for all your hard work and belief in this country...! Hopefully it will get us past this latest abuse and all the abuses to come...
Thank you, for the article, professor, I just heard from, politico , at the Jim Acosta show that immigration bill passed. They think reform will happen, I don’t agree with them! I am very disappointed with those democrats who voted for the bill, it passed the Senate despite, the killing of Renee Nichole Good.
I was upset about this too, but then I read some more detailed reporting about the spending bill. It said that most of ICE's funding is coming from the Big Bad Bill that was passed in 2025 ($30B for enforcement operations and $45B for detention facilities, if I recall correctly. The bill that just passed is DHS' normal funding which includes TSA and other things in addition to some ICE funding. The bottom line is that blocking this DHS funding would not have any real impact on ICE because ICE already have most of their funding. Sadly.
Thank you for this. I’ve said the same thing in a couple of places; that ICE would be just fine if the bill were defeated but there were other things in the bill that needed to be funded. It’s aggravating to have people go nuts over one thing in a complex issue. This is a prime example of Democrats in their usual circular firing squad shooting each other instead of those who really need their attention. We are really good at helping republicans divide and conquer our own selves 🤨.
Yes, it is maddening when “people go nuts over one thing in a complex issue” when voting, too. They usher in something that surpasses the thing they were upset about in terms of misery, pain, illegality and destruction. Like all those who voted for trump or didn’t vote, or voted third party…and here we are. I don’t think I will ever forgive or forget the ignorance, stupidity, holier-than-thou purity.
yes. What passed is no greater than usual and without OBBA wouldn't be enough for all this. But without passing this bill, OTHER parts of DHS which we need (cybersecurity, FEMA, etc) wouldn't have even the meager funding those places are now getting. What we REALLY need is to abolish DHS --not just ICE--and put immigration back on its own and the other functions elsewhere Then the funding wouldn't get mixed up this way.
Who are the Dems who voted for it? Also, when these ex-convicts posing as ICE agents start getting shot for breaking and entering, maybe that will stop them.
And when people do attempt to defend themselves is when the machine guns will come out to mow down peaceful protesters in the streets wholesale. Mainstream media will label them as "domestic terrorists."
Attended Senator Merkley's town hall Saturday, Senator Wyden's town hall this evening. I am so so thankful they are my senators. My representative Suzanne Bonamici is also fighting the good fight. All three are doing all they can to battle back on so many fronts. I email them often to say "Yes, I agree/fight harder AND thank you." This blue state thankfully has them to fight back against the ongoing recriminations from this admin.
The Republicans made a big mistake in having the unflappable Jack Smith testify today. Hopefully the testimony will serve as a stark reminder of the Jan. 6 insurrection and Trump’s crimes in the face of the Trump administration’s efforts to whitewash history. The midterms are not that far down the road, and history will surely repeat itself.
Republicans aren’t watching it, and if they do they think the little argument over what Cassidy Hutchinson said is more important, and thirdly Fox Noise will bury this and have them correctly brainwashed by November.
I suspect, in a fairly short period of time, that some homeowner served with an administrative warrant will then defend his home with firearms, and we will have a very bad situation occur. It almost seems like this is being done by design by ICE.
This white 63-year-old female will certainly use her legal firearms to prevent men in black tactical gear with firearms and masks covering their faces from breaking into her home. I am a law-abiding citizen with proven genealogy going back to the Mayflower. This is not to say that any one of these THUGS would even care.
If you come illegally to my home, break down my door and with deadly intent, try to kill me, I'm taking some of YOU thugs down with me. Don't f*cking mess with me. I live in Texas and we like our Castle Laws. At this point concerning ICE, I wish everyone would defend themselves with the same force as ICE is illegally using against us.
I don't want a civil war. But if this corrupt government continues to kill its citizens, I will do everything in my power to kill the THUGS first. I will probably die, but I'm not the ones who are roaming the streets with masked faces looking for citizens to kill.
I sympathize with you, and I’d like to do the same, but I’m almost 72 and am completely dependent on SS benefits and a Federal pension and can’t risk that, and want to live to enjoy retirement and pass savings and income on to my younger wife.
This administration is doing so much bad shit that I could spend the better part of every day writing letters to Congress members or calling their offices and relaying my
complaint to a “clerk” in their office.
Perhaps I should just create a form letter with the “fill in the blank” for what I find egregious, unlawful, and just totally amoral, cruel, and not living up to the ideals of this country.
So what is being done to prosecute the asshole that murdered Renee Nicole Good? It’s difficult to find the energy to speak out against the latest atrocity of the day when it seems no one is able to do anything about the last ten. Where are the unredacted Epstein files?
This country is in a ditch that it can’t seem to dig itself out of.
Thank You 🙏🏼 Joyce, we especially appreciate you sharing the sample warrants for us to compare visually; that helps‼️
Joyce I am deeply disturbed to realize that our very own federal government is actually turning against the people of this nation and also to realize that the primary motivation for this aberrant behavior is, wait for it… MONEY‼️ 💵 ‼️🤬
This is Crony Capitalism at its absolute WORST‼️🤬🤬🤬 The companies that build and operate mass incarceration facilities are the ones making the most money in THIS context but there are many other enablers in the high tech biz and don’t forget finance and crypto and all that AI 🤖 stuff‼️
Bottom Line for me is we need to be more aggressive about “shining some SUNLIGHT” on these nefarious shenanigans in our nation’s capital - Sooner Than Later and The Sooner the Better‼️🤯😡
I would also like to point out AGAIN that there are MORE OF US THAN THERE ARE OF THEM‼️👏🏼😅
I live in a red state. My email to my Congressman today after calling and writing about ICE funding and ICE’s actions several times in the past couple of weeks:
Why did you vote to give ICE even more taxpayer dollars when their budget has already exploded? Your vote shows your support for the abuses of ICE toward immigrant communities. You are complicit in breaking up families, illegal traffic stops, unlawful home invasions, terrorizing neighborhoods, attacking peaceful protestors, and denying people their due process rights and sending them to inhumane holding facilities. Our immigration system is broken, but doing mass, military style roundups using racial profiling is not the solution. The majority of those grabbed off the streets, from their homes, and from their cars have NO CRIMINAL RECORDS. Many are here legally, taking all the right steps to remain hard working, tax paying members of society. That you can’t see how wrong this is tells me all I need to know about your character and your lack of support for democracy and our Constitution. But hey, support for your party & your fealty to one man is more important than the concerns of our country and the people you serve, right?
“When Members of Congress take office, they swear an oath not to a party, a president, or a political movement, but to the Constitution of the United States.”
“A few days ago, we published a court-ready constitutional complaint on our website. It’s written for filing by a sitting Member of Congress and asks a federal court to answer a very old, very inconvenient question: whether Section 3 of the Fourteenth Amendment still means what it says when a President gives aid or comfort to insurrectionists. You can’t file this lawsuit yourself, but your U.S. Representative can.”
(click link below for full article w/cover letter)
“What follows is a short cover letter you can use to send the draft complaint to their office and politely remind them that defending the Constitution is not a vibe, a talking point, or a press release. It’s literally their job.”
I've DEMANDED my Congress people REFUSE to allow the Continuing Resolution due by January 30th to pass without pulling back funding from ICE and forcing them to adhere to our constitution. As Trump himself says, "We can do this the easy way, or the hard way." I watched a news conference yesterday with the group of Democrats who have put together a bill of impeachment (is that the right term?) against Kristi Noem. They were so inspiring!
It’s Articles of Impeachment. 💟
David, I hear you loud and clear. I will soon celebrate my 83rd birthday and am constantly reading some of the most hateful comments by people who support this fascist regime. We are living in a time when each day is worse than the one before.

Check your state laws. Some states allow it with a warrantless search.
And, Florida!
Different states have different directives regarding the Castle Doctrine. Best to look up an individual state and see how it defines what can be done using that doctrine.

Discretion is the better part of valor.
Depends how good a shot you are. Look at all the areas not protected. Groin shots are highly effective.
I’m 78 too. And, I feel as if I have stepped into an alternate reality.
Turning 74 in a few months. Got US citizenship last year (I’m also a Canadian) and am suffering from acute regret. This is not the country I grew up side by side with.

lucky you!!
me too, at 81 "and a half"
David, I am your age, and I feel the same. Where are the people who should be insisting the ice insanity stops!
It's going to be all of US at the ballot box come this November.
We'll be voting like our lives depended on it.
Continued
Again, thank you
Joyce.
My best,
Regina Cornwell
I am 74 and feel exactly the same way😡🤬
Thanks, Joyce. I especially appreciate you showing samples of the two types of warrants.
That was very helpful

I agree. Reinstate INS under DoJ.
Heh, under THIS DOJ that wouldn’t improve things, but at least it would make just one Cabinet member to impeach
Good catch - I didn’t mean *this* DoJ!
Thank you, Cathy!
Who are the Dems who voted for it? Also, when these ex-convicts posing as ICE agents start getting shot for breaking and entering, maybe that will stop them.
Tom Suozzi (New York)
Henry Cuellar (Texas)
Don Davis (North Carolina)
Laura Gillen (New York)
Jared Golden (Maine)
Vicente Gonzalez (Texas)
Marie Glusenkamp Perez (Washington)
And when people do attempt to defend themselves is when the machine guns will come out to mow down peaceful protesters in the streets wholesale. Mainstream media will label them as "domestic terrorists."
Then ICE will just shoot and kill everyone in the house.
I believe the votes are public records and you can find who voted for and against.
Augh!
Joyce 💕
Thank you for providing “teaching tools” for visual learners like me!
Some days are shell shocking cray-cray
And then Jack Smith & Michael Fanone & (fuck) Cancer survivor Jaime Raskin show us Truth to Power !
It’s mind boggling how the maga republicans act like they all need to be Dinozzoed upside the head!!
They’d all be total whiners if their 4th Amendment rights were violated.
If someone charged into their homes & threatened their families…
Or when they piss off the idiot bully & he comes after them…
Joyce? When will Renee Good’s murderer be arrested?
And The TrumpStein Files?? Where are they?
Joyce I hope you’re well rested
You are a Light ✨in this darkness
Thank you for all you’re doing to keep us informed & somewhat Sane
The Supreme Court help set us all up for this mess.
The Fourth Amendment. We fought a revolution to get it.

Yes, the Core Republican voters won’t change their views. I’m mostly thinking about the Independents who are the voters who decide these elections.

Perhaps I should just create a form letter with the “fill in the blank” for what I find egregious, unlawful, and just totally amoral, cruel, and not living up to the ideals of this country.
The whole mess is appalling and frightening. My heart cries for the families being traumatized by these people.
My heart cries for all residents (legal or not) who are being traumatized by these people.
Wow!!! This says everything. Well done Bobbie.

“What follows is a short cover letter you can use to send the draft complaint to their office and politely remind them that defending the Constitution is not a vibe, a talking point, or a press release. It’s literally their job.”
